• AN ORDINANCE <br />AMENDING AND REORDAINING SECTION 19-110 OF CHAPTER 19 <br />OF THE CHARLOTTESVILLE CITY CODE, 1990, AS AMENDED, <br />RELATING TO EMPLOYMENT OF RETIRED CITY EMPLOYEES. <br />BE IT ORDAINED by the Council for the City of Charlottesville, <br />Virginia, that Section 19-110 of Article IV of Chapter 19 of the <br />Charlottesville City Code is hereby amended and reordained as <br />follows: <br />Section 19-110. Corrections and other effects on benefits. <br />(a) Should any change or error in records result in any <br />member or beneficiary receiving from the plan more or less than he <br />would have been entitled to receive had the records been correct, <br />then on discovery of such error the commission shall correct it, <br />and as far as practicable, shall adjust the payments in such a <br />manner that the actuarial equivalent of the benefit to which such <br />member or beneficiary was correctly entitled shall be paid. <br />(b) Except as otherwise provided herein and in section 19- <br />103, the fact that a former member is employed after retirement <br />will not affect the payment of the benefits to which he or she is <br />entitled under the provisions of this article. However, should a <br />• former member be again employed by the city full-time or part-time <br />at any time subsequent to retirement under seetzlen '^ 9 Article IV <br />of Chapter 19 of this Code r__ anype___d so that he actually works <br />in excess of one thousand (1.000) hours in <br />any calendar year, his retirement allowance shall thereupon cease; <br />he shall resume the status of a member of the plan, and his <br />previous period of creditable service shall be reestablished. Any <br />benefits which may become payable thereafter under any of the <br />provisions of this article upon subsequent retirement or death <br />shall be computed in accordance with the applicable provisions of <br />this article as if the previous retirement had not occurred based <br />on the total of his creditable service before and, if applicable, <br />after his period of retirement. <br />Approved by Council <br />December 20, 1993 <br />erk of City Council <br />• <br />
