• AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF HAZEL STREET <br />WHEREAS, proper notice that John F. Loehr would request the <br />City Planning Commission to initiate street closing procedures to <br />close a portion of Hazel Street, approximately 50 feet in width, <br />from its intersection with St. Charles Avenue running east a <br />distance of 393 feet to Locust Avenue, was duly posted and <br />advertised; <br />WHEREAS, owners along the street proposed to be vacated have <br />been duly notified; <br />WHEREAS, a joint public hearing by the Planning Commission and <br />City Council was held on November 9, 1993, and comments from the <br />City staff, the Planning Commission and the public were made and <br />heard; and <br />WHEREAS, the Planning Commission recommended closure of said <br />portion of Hazel Street; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that the above -referenced portion of Hazel Street, <br />• described as follows, is hereby closed, vacated and discontinued as <br />a public thoroughfare of the City of Charlottesville, Virginia, <br />said street not being needed for public use and travel: <br />That portion of Hazel Street right-of-way, <br />approximately 50 feet in width, from its <br />intersection with St. Charles Avenue running <br />east a distance of 393 feet to Locust Avenue, <br />adjoined by parcels 23, 24, 25 and 25.1 on <br />City Real Estate Tax Map 51. <br />PROVIDED, HOWEVER, that the City of Charlottesville hereby <br />reserves unto itself a perpetual easement twenty feet in width down <br />the center of the Hazel Street right-of-way being vacated, <br />including the perpetual right of ingress and egress over the <br />vacated area for the purpose of installing, maintaining, repairing <br />or replacing utility lines or mains, including drains, swales or <br />pipes designed to handle storm water run-off. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall <br />send a copy of this ordinance with plat attached to the Clerk of <br />the Circuit Court for recordation in the current street closing <br />book. <br />Approved by Council <br />December 20, 1993 <br />C>k of City Council <br />
