1 <br />• <br />• <br />9 <br />AN ORDINANCE <br />AMENDING EORDAINING SECTIONS 4-2 and 4-38, AND <br />ADfIq—XG A NEW SECTION NUMBERED 4-41, <br />OF THE CHARLOTTESVILLE CITY CODE, 1990, AS AMENDED, <br />REGARDING LEASHES ON DOGS. <br />BE IT ORDAINED by the Council for the City of Charlottesville, <br />Virginia that Sections 4-2 and 4-38 of Article I of Chapter 4 of <br />the Code of the City of Charlottesville, 1990, as amended, are <br />hereby amended and reordained, and a new section numbered 4-41 is <br />hereby added to said Code, all to read as follows: <br />Section 4-2 <br />ARTICLE I <br />Definitions. <br />The following words, terms <br />chapter, shall have the meanings <br />except where the context clearly <br />IN GENERAL <br />and phrases, when used in this <br />ascribed to them in this section, <br />indicates a different meaning: <br />Animal warden . . . <br />Cat . . . <br />Dog means every dog, regardless of sex or age. <br />Leash means a physical restraint appreximately c-__ "_ ` F,. . <br />3:n length, made of leather, chain, rope, or other reasonably strong <br />material, ene "` end ef which is securely attached to a dog's t-lae <br />collar or harness e€—animal and which is intended to be held by <br />an owner of a dog or attached to <br />an immovable object. <br />Owner means every person having right of property or custody <br />in an animal or who keeps or harbors an animal or has it in his <br />care. <br />To run at large or running at large means to roam, loiter, <br />walk, run or be on or off the premises of the owner without being <br />fenced, caged, physically carried, held by leash by a person <br />thoroughly capable both physically and mentally of controlling the <br />animal. or within the immediate voice control of the owner. <br />Section 4-38. Running at large. <br />It shall be unlawful for the owner of any dog to allow such <br />dog to run at large, at any time, within the city, even though the <br />dog is both lawfully licensed and vaccinated. Any person violating <br />this section shall be guilty of a Class 4 misdemeanor; provided <br />that, upon a fourth conviction within one (1) year of any offense <br />under this section involving the same dog, the defendant shall be <br />deemed guilty of a Class 3 misdemeanor. <br />Section 4-39. Dogs prohibited in certain business <br />establishments; exceptions. <br />
