AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />AN ALLEY OFF BOOKER STREET <br />WHEREAS, proper notice that Burton Fowler would request the <br />City Planning Commission to initiate street closing procedures to <br />close an alley off Booker Street, 15 feet in width, from its <br />intersection with Booker Street running east a distance of 125 feet <br />along the north side of 628 Booker Street (City Tax Map 36-89), was <br />duly posted and advertised; <br />WHEREAS, owners along the alley proposed to be vacated have <br />been duly notified; <br />WHEREAS, a joint public hearing by the Planning Commission and <br />City Council was held on October 10, 1995, and comments from the <br />City staff, the Planning Commission and the public were made and <br />heard; and <br />WHEREAS, the Planning Commission recommended closure of said <br />alley off Booker Street; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that the above -referenced alley off Booker Street, <br />described as follows, is hereby closed, vacated and discontinued as <br />. a public thoroughfare of the City of Charlottesville, Virginia, <br />said alley not being needed for public use and travel: <br />The alley located perpendicular to Booker <br />Street, 15 feet in width, running from its <br />intersection with Booker Street to its <br />terminus 125 feet in an easterly direction, <br />and adjacent to Parcels 65, 66, 67 and 89 of <br />City Real Property Tax Map 36. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall <br />send a copy of this ordinance with plat attached to the Clerk of <br />the Circuit Court for recordation in the current street closing <br />book. <br />Approved by Council <br />November 20, 1995 <br />C e k of City Council <br />
