AN ORDINANCE <br />• AFFIRMING THE CREATION OF A SPECIAL ASSESSMENT DISTRICT <br />PURSUANT TO VIRGINIA CODE 95 15.1-239, et sea., <br />ESTABLISHING THE PORTION OF PROJECT COSTS TO BE LEVIED <br />AS AN ASSESSMENT ON THE PROPERTIES IN SUCH DISTRICT; <br />RECITING THE FINDINGS OF CITY COUNCIL IN REGARD TO THE <br />BENEFITS ACCRUING TO PROPERTIES WITHIN SAID DISTRICT; <br />ESTABLISHING THE AMOUNT OF THE ASSESSMENT TO BE LEVIED <br />ON EACH SUCH PROPERTY; LEVYING SAID ASSESSMENTS <br />AND PROVIDING FOR THE TIME, MANNER AND TERMS <br />OF THE COLLECTION THEREOF. <br />• <br />• <br />BE IT ORDAINED by the Council of the City of Charlottesville: <br />SECTION 1. The action of City Council taken at a meeting on <br />April 18, 1994, creating a special assessment district in the Third <br />Street, S.E. Mall area, is hereby ratified and affirmed. The Council finds and declares that the total cost <br />of the improvements to the Third Street, S.E. Mall area, including, <br />but not limited to, the replacement of sidewalks and street <br />pavement, the replacement and expansion of facilities for storm <br />water drainage and the installation of lighting, landscaping, and <br />other permanent amenities, is $369,012.94, and that $76,137.00 of <br />1 <br />
