O AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />.A PORTION OF NINTH STREET, SW <br />WHEREAS, proper notice was duly posted and advertised that <br />Denico Development Company would request the City Planning <br />Commission to initiate street closing procedures to close that <br />portion of Ninth Street, SW from West Main Street to the CSX <br />railroad track, approximately thirty feet (30') in width, running <br />a distance of 232 feet; <br />WHEREAS, owners along the street proposed to be vacated have <br />been duly notified; <br />WHEREAS, a joint public hearing by the Planning Commission and <br />City Council was held on February 13, 1996, and comments from the <br />City staff, the Planning Commission and the public were made and <br />heard; and <br />WHEREAS, the Planning Commission recommended closure of said <br />portion of Ninth Street, SW, with certain conditions; now, <br />therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that the above -referenced portion of Ninth Street, SW, <br />® described as follows., shall be closed, vacated and discontinued as <br />a public thoroughfare of the City of Charlottesville, Virginia, <br />upon the completion of the 9th/10th Street realignment project by <br />the Virginia Department of Transportion, said street not being <br />needed for public use and travel: <br />That portion of Ninth Street, SW, <br />approximately 30 feet in width, from its <br />intersection with West Main Street to the CSX <br />tracks, a distance of approximately 232 feet. <br />PROVIDED, HOWEVER, that closing of this portion of Ninth <br />Street, SW shall not become effective until the following <br />conditions are met: <br />(1) That parcels 76 and 78 on City Real Estate Tax Map 10, <br />and Parcels 5, 6 and 7 on City Real Estate Tax Map 30 be <br />combined with adjoining parcels under the same ownership <br />having frontage on West Main Street, in order to prevent <br />any one parcel from being landlocked by the closing; and <br />(2) The 9th/10th Street Realignment Project is completed by <br />the Virginia Department of Transportation. <br />PROVIDED, FURTHER, that the City of Charlottesville hereby <br />reserves unto itself a perpetual easement ten feet in width on <br />• either side of the center line of any water, gas, sanitary or storm <br />sewer mains presently located in the area being vacated, including <br />
