AN ORDINANCE <br />• TO AUTHORIZE THE CONVEYANCE OF CITY RIGHT-OF-WAY <br />LOCATED ON EAST MARKET STREET <br />TO THE UNITED WAY - THOMAS JEFFERSON AREA <br />WHEREAS, the United Way - Thomas Jefferson Area ("United Way") <br />owns the building and land located at 413 East Market Street, and <br />a recent survey of the property reveals that the building <br />encroaches onto the City right-of-way by approximately six inches <br />(6"); and <br />WHEREAS, United Way wishes to acquire a portion of the City <br />right-of-way adjacent to 413 East Market Street, designated as <br />Parcel "X" on the attached plat dated January 25, 1996, consisting <br />of 16.53 square feet of property, in order to cure the encroachment <br />problem in connection with the sale of the subject building and <br />land to a private developer; and <br />WHEREAS, the United Way property, currently tax exempt because <br />of United Way's nonprofit status, will become taxable property upon <br />its sale to a private developer, generating significant tax revenue <br />for the City; and <br />WHEREAS, City staff have reviewed the United Way request, and <br />recommend its approval with the condition that United Way agree to <br />• maintain and keep in good repair the handicapped access ramp at the <br />southeast entrance of the United Way building, which ramp was <br />installed in a City sidewalk by Region Ten Community Services Board <br />in 1994; <br />Now therefore, BE IT ORDAINED by the Council of the City of <br />Charlottesville, Virginia that the conveyance of the property <br />designated as Parcel "X" on the above -referenced plat dated <br />January 25, 1996, is hereby authorized, and the Mayor is hereby <br />authorized to execute a quitclaim deed, in form approved by the <br />City Attorney. The quitclaim deed shall include language requiring <br />United Way, its successors in title and assigns, to: (1) Maintain <br />the handicapped ramp located within the City right-of-way at the <br />southeast entrance to the building, and hold the City harmless from <br />liability or damages by reason of the encroaching handicapped ramp, <br />or (2) remove the handicapped ramp (if not required by ADA) at no <br />cost to the City. The City Attorney is hereby authorized to take <br />whatever steps are necessary to effect the closing of said property <br />conveyance. <br />Approved by Council <br />February 20, 1996 <br />Werk of City Council <br />
