which has been assembled or combined to alert police to an unlawful <br />• entry or other activity requiring an immediate police response. <br />Alarm User. Any person or entity (but not a governmental <br />agency or department) owning or leasing an Alarm System or the <br />premises on which such Alarm System is maintained. <br />Automatic Communication Device. Any device or combination of <br />devices that will, upon activation, either mechanically, <br />electrically, automatically or by any other means, initiate the <br />intrastate calling, dialing or connection to a telephone number, <br />line or other instrument assigned to the City, its Police <br />Department, or its Emergency Communications Center. <br />False Alarm. The activation of any Alarm System, eliciting a <br />response from the City Police Department when, in fact, a situation <br />requiring such response (i.e., involving actual or threatened <br />criminal activity constituting an immediate danger to life or <br />property) does not exist, and such activation is through mechanical <br />or electronic failure, malfunction, improper installation, and/or <br />the negligence of the Alarm User, his employees or agents. The <br />term shall not include an alarm caused by unusually violent <br />conditions of nature, electrical power disruptions or failure of <br />equipment at the City's police Emergency Operations Center. <br />Section 20-34. Prohibited acts. <br />• (a) No person or entity shall use, operate, install or <br />maintain an Alarm System at any location in the City without first <br />complying with the provisions of Section 20-35 of this Article. <br />(b) No person or entity shall use an Alarm System when <br />permission to use such system has been denied or revoked pursuant <br />to Section 20-37 herein, and no person or entity shall fail to <br />disconnect such Alarm System within ten (10) days after such denial <br />and/or revocation. <br />(c) No person or entity shall install, use or maintain on any <br />premises within the City any Alarm System which delivers, or causes <br />to be delivered, any pre-recorded message(s) to any telephone <br />number or line assigned to the City, its Police Department or its <br />Emergency Communications Center. <br />(d) No person or entity shall cause an Automatic <br />Communication Device to be installed on or connected to any <br />telephone line leading into a City building, other than a line <br />specified or designated by the Chief of Police for such purpose. <br />Section 20-35. Registration of Alarm System required. <br />(a) Prior to installing, using or maintaining any Alarm <br />System on any premises within the City, an Alarm User shall provide <br />• Page 2 <br />
