through agents offers for sale or sells and, at the time of such offering for sale, delivers goods, wares <br />• and merchandise to retail customers, is a peddler. <br />Every peddler operating in the city shall obtain and maintain a current city business license <br />and shall pay an annual license tax of ninety <br />one hundred twenty five dollars ($125.00). <br />Every vehicle used in peddling shall have conspicuously displayed thereon the name of the <br />peddler, together with the street and number, city and state of his residence. <br />Any person selling or offering to sell as a peddler shall exhibit his license on demand of any <br />citizen of this city; and upon his failure or refusal to do so, he shall be subject to the penalties for <br />doing business without a license. <br />The word "peddler" or peddlers," as used in this section, shall be construed as including their <br />bona fide employees. <br />This subsection shall not apply to wholesale merchants regularly licensed by the city and who <br />shall at the same time sell and deliver merchandise to retail merchants. <br />• Hi Notwithstanding the foregoing, no city license shall be required of peddlers of wood, meat, <br />milk, butter, eggs, poultry, fish, oysters, game, vegetables, fruit or other family supplies of a <br />perishable nature grown or produced by them and not purchased by them for sale, or to the activities <br />listed below in Section 14-20-(c). <br />(-2) All peddlers of family supplies of a perishable nature grown or produced by them and not <br />purchased for sale shall annually file with the Commissioner of Revenue a certificate in duplicate <br />under oath in which shall be given the name and post office address of the applicant, the location of <br />the land on which the family supplies of a perishable nature are produced or are to be produced, <br />whether the applicant is the owner thereof or renter, and in the latter case, the name of the landlord <br />or owner and the time from which and to which the lease is to run. <br />(3) Upon receipt of such certificate and such other evidence under oath as may be sufficient to <br />establish the fact that the applicant is entitled to the certificate, the Commissioner of Reventie shall <br />endorse on one (1) copy of such certificate the fact and date of its filing and shall deliver such copy <br />to the applicant. The applicant shall thereafter, at all times while engaged in peddling within this <br />city, have such copy in his possession, and upon request by an officer of the city charged with <br />enforcing of this chapter, exhibit such certificate. The CommissionerRevenae and his employees <br />may administer the oaths required by this subsection. <br />(4) Any peddler failing to exhibit such certificate in violation of this subsection, or making any <br />false statement in the certificate or affidavit aforesaid, or by permitting the certificate to be used in <br />• Page 15 of 26 <br />
