AN ORDINANCE <br />' AMENDING AND REORDAINING SECTIONS 11-131 AND 11-132 <br />OF ARTICLE V, CHAPTER 11 OF THE CHARLOTTESVILLE CITY CODE, 1990, <br />AS AMENDED, RELATING TO THE DOLLAR LIMITS <br />FOR SETTLEMENT OF CLAIMS. <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that Sections <br />11-131 and 11-132 of Article V, Chapter 11 of the Charlottesville City Code, 1990, as amended, <br />are hereby amended and reordained. <br />ARTICLE V. RISK MANAGEMENT FUND <br />Section 11-131. Compromise and payment of claims against city. <br />Claims for damages made against the city not covered by insurance or falling within the <br />deductible limits of any coverage may be paid from the risk management fund with the following <br />limits: <br />(a) Claims of five thousand dollars ($5.000.00) or less shall <br />be paid by the director of finance from the risk management fund upon certification by the city <br />attorney and the director of finance that the city is liable for payment or that the amount to be paid <br />is recommended as a compromise of a claim involving disputed liability. <br />(b) Claims of more than five thousand dollars ($5.000.00) <br />but not more than fifteen thousand dollars ($15,000.00) shall be <br />paid by the director of finance from the risk management fund upon certification by both the city <br />attorney and the city manager that the city is liable for payment or that the amount to be paid is <br />recommended as a compromise of a claim involving disputed liability. <br />(c) Claims in excess of fifteen thousand dollars <br />($15.000.00) shall be paid from the risk management fund only after authorization from city council. <br />Section 11-132. Compromise of claims on behalf of City. <br />Whenever any sum of money due the city or any account shall be the subject of dispute, the <br />same may be compromised according to the following authorization: <br />(1) The director of finance may make written authorization for a reduction of not more <br />than one thousand dollars ($1.000.00) in any utility <br />account. <br />(2) Either the city manager, the director of finance or the city attorney may make written <br />authorization of a compromise of any other type of account or claim by a reduction <br />. of not more than one thousand dollars ($1.000.00). <br />
