• ORDINANCE <br />APPROVING ACQUISITION AND CONVEYANCE OF EASEMENTS <br />RELATED TO THE UNION STATION PROJECT; <br />GRANTING AUTHORITY TO THE CITY MANAGER TO SIGN <br />CONTRACTUAL DOCUMENTS FOR SAID PROJECT; AND <br />APPROPRIATION OF ISTEA FUNDS FOR SAID PROJECT. <br />WHEREAS, by resolution approved July 3, 1993, the City Council authorized <br />application for federal funding under the Intermodal Surface Transportation Sufficiency Act <br />(ISTEA) to allow renovation of the West Main Street train station, and $762,000 in federal <br />funding has been approved; and <br />WHEREAS, the developer for this project, Union Station Partners, LLC ("Developer"), <br />is prepared to take title to the property and proceed with the renovation of the train station; and <br />WHEREAS, in order for the Developer to proceed, (1) certain utility and aerial <br />easements must be conveyed by the City to the Developer; (2) the City Manager must be given <br />authority to sign on behalf of the City the various contracts and closing documents; and (3) the <br />City must formally appropriate the $762,000 in federal funds to the Developer; now, therefore, <br />is BE IT ORDAINED by the Council for the City of Charlottesville, Virginia, that: <br />(1) The Mayor is hereby authorized to execute in behalf of the City any and all deeds, in <br />form approved by the City Attorney, for the project, including those granting utility, aerial, and <br />other necessary easements. <br />(2) The City Manager is hereby authorized to execute on behalf of the City any and all <br />documents, including contracts, which are necessary to cause the renovation of the train station <br />by the Developer in an expeditious manner; provided, however, that said documents shall be <br />reviewed, and in a form approved by the City Attorney prior to execution by the City Manager. <br />(3) This Council hereby appropriates the sum of $762,000.00, to be received from the <br />Virginia Department of Transportation as pass-through federal funds, to Union Station Partners, <br />LLC to be used solely for costs associated with the purchase and renovation of the West Main <br />Street train station property; provided, however, that this appropriation is conditioned upon <br />receipt of $762,000.00 in ISTEA funds from the Virginia Department of Transportation. <br />Approved by Council <br />October 6, 1997 <br />0k of City Council <br />
