• AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF CASTALIA STREET RIGHT-OF-WAY <br />WHEREAS, proper notice was duly posted and advertised that James and Angelina Dennis <br />would request the City Planning Commission to initiate street closing procedures to close a portion <br />of the unopened right-of-way of Castalia Street, approximately 50 feet in width and running a <br />distance of approximately 267 feet between Montrose Avenue and Elliott Avenue, shown on the <br />attached map drawn by the City Community Development Department; <br />WHEREAS, owners along the street proposed to be vacated have been duly notified; <br />WHEREAS, a joint public hearing by the Planning Commission and City Council was held <br />on July 8, 1997, and comments from the City staff, the Planning Commission and the public were <br />made and heard; and <br />WHEREAS, the Planning Commission recommended closure of said portion of Castalia <br />Street on the condition that the City retains a ten foot (10') easement for the purpose of allowing <br />pedestrian and bicycle traffic, and possible installation of utility lines; now, therefore, <br />• BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the above - <br />referenced portion of the Castalia Street right-of-way, described as follows, is hereby closed, vacated <br />and discontinued as a public thoroughfare of the City of Charlottesville, Virginia, said street not <br />being needed for public use and travel: <br />That portion of the Castalia Street right-of-way, approximately 50 <br />feet in width and running a distance of approximately 267 feet from <br />Montrose Avenue and Elliott Avenue, shown on the attached map <br />drawn by the City Community Development Department, and located <br />on City Real Estate Tax Map 60 adjacent to Parcels 39, 40, 156, and <br />155. <br />PROVIDED, HOWEVER, that the City of Charlottesville hereby reserves unto itself a <br />perpetual easement ten feet in width: (1) on either side of the center line of any water, gas, sanitary <br />or storm sewer mains presently located in the area being vacated, including the perpetual right of <br />ingress and egress over the vacated area for the purpose of installing, maintaining, repairing or <br />replacing such utility lines or mains; and (2) for public pedestrian and bicycle traffic through the <br />above-described portion of the Castalia Street right-of-way. Said pedestrian and bicycle easement <br />shall be located five feet on each side of the original centerline of the Castalia Street right-of-way <br />now being closed. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall send a copy of this <br />• ordinance with plat attached to the Clerk of the Circuit Court for recordation in the current street <br />closing book. <br />Approved by Council��y�Q, IiYL <br />September 15, 1997 Jerk of City Colluncil <br />
