AN ORDINANCE <br />• AMENDING AND REORDAINING SECTION 4-41 <br />OF THE CHARLOTTESVILLE CITY CODE, 1990, AS AMENDED, <br />RELATING TO A LEASH REQUIREMENT FOR DOGS <br />ON THE DOWNTOWN MALL. <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that Section <br />4-41 of Article II of Chapter 4 of the Charlottesville City Code, 1990, as amended, is hereby <br />amended and reordained as follows: <br />ARTICLE Il. DOGS GENERALLY. <br />Section 4-41. Leashes required for dogs in certain areas. <br />(a) Notwithstanding other provisions of this chapter, dogs shall be kept on a leash and <br />under control in Pen Park, including Meadow Creek Golf Course, on the downtown pedestrian <br />mall between the Ninth Street bridge and Ridge -McIntire Road, and on all side streets between <br />Water Street and Market Street which adjoin the downtown mall; provided, however, that dogs in <br />a sanctioned obedience or training show, trial, class, or similar event held in Pen Park shall not <br />• be required to be on a leash, while they are actually participating in such an event. <br />(b) Any person who violates this section by failing to have his or her dog on a leash in the <br />areas so designated herein shall be guilty of a Class 4 misdemeanor; provided that, upon a third <br />conviction within one (1) year of any offense under this section involving the same dog, the <br />defendant shall be deemed guilty of a Class 3 misdemeanor. <br />Approved by Council <br />August 18, 1997 <br />-- � <br />C rk of City Council <br />0 <br />
