AN ORDINANCE <br />• TO AMEND AND REORDAIN SECTION 29-43 OF CHAPTER 29, and <br />SECTIONS 34-464, 34-465, 34-671, 34-681, 34-779, 34-804, and 34-857.1 <br />OF CHAPTER 34 OF THE CHARLOTTESVILLE CITY CODE, 1990, <br />AS AMENDED, RELATING TO VARIOUS ZONING AMENDMENTS. <br />• <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that Section <br />29-43 of Article II of Chapter 29, and Sections 34-464, 34-465, 34-671, 34-681, 34-804, and <br />34-857.1 of Chapter 34 of the Charlottesville City Code, 1990, as amended, are hereby amended <br />and reordained, as follows: <br />CHAPTER 29. SUBDIVISIONS <br />ARTICLE II. Design Standards and Improvements. <br />Sec. 29-43. Preservation of natural features and amenities. <br />(a) Generally. Existing natural features which would add value to residential <br />development or to the City as a whole, such as trees, watercourses, historic spots and similar <br />irreplaceable assets shall be protected wherever practicable in the design of the subdivision. <br />(b) Existing trees. <br />(1) The applicant shall make a bona fide effort to protect existing trees in the <br />design and development of a subdivision and to replace those trees necessarily removed during <br />such development. <br />(2) All trees which are to be retained shall be marked and protected during <br />construction, with tree wells provided where necessary to protect the tree from changes in grade. <br />(3) Trees shall be provided to the extent that, at ten (10) years from planting, <br />minimum tree canopies or covers will be provided as follows: <br />Zoning Districts <br />Percentage of Site Cover <br />R-3, B-1, B-2, B-3, <br />B-4, B-5, 13-6. M-1, M-2 ........................ Ten percent (10%) <br />R-2 .................................... Fifteen percent (15%) <br />R-1, R-lA ............................... Twenty percent (20%) <br />The area to be occupied by the building footprint(s) and driveway access area(s) proposed <br />for a development site shall be subtracted from the gross site area before calculating required <br />tree coverage only when the site is located within that portion of the City described in section <br />34-699 (where off-street parking is not required). This exclusion from gross site area <br />calculations shall be allowed whether or not the proposed development will add more than ten <br />
