operate a passenger motor vehicle for hire without posing a threat to the safety or welfare of the <br />public. Any of the above -listed circumstances shall be grounds for denying, suspending and/or <br />revoking a driver's registration. <br />B. In the event that an applicant for registration pursuant to Section 32-3 of the City <br />Code is denied such registration due to a record reflecting any of the circumstances listed in <br />Paragraph 2(A)(1) and/or Paragraphs 2(A)(3)-(8), above, the individual may appeal the denial <br />of the registration to the City Manager through the process specified in Section 32-2(d)(2) of the <br />City Code. <br />1. If the applicant presents evidence convincing to the City Manager that, despite <br />the presence of circumstances listed in Paragraph 2(A)(1) and/or Paragraphs 2(A)(3)-(8), <br />above, the applicant has demonstrated his ability and integrity to safely operate a <br />passenger motor vehicle for hire in accordance with the law and without posing a danger <br />to the health, safety or welfare of passengers or the general public, then the City <br />Manager may authorize that individual's registration. The Chief of Police shall also be <br />given an opportunity to be heard on the issue of whether the application for registration <br />should be granted or denied. <br />2. Once such registration is authorized by the City Manager, then none of the <br />circumstances listed in Paragraph 2(A)(1) and/or Paragraphs 2(A)(3)-(8), (so long as such <br />circumstances were known to the City at the time of the determination rendered pursuant <br />• to Paragraph 2(B)(1), above), shall prevent the individual driver from obtaining future <br />registrations. However, a determination by the City Manager pursuant to Paragraph <br />2(B)(1), above, shall not preclude the City from taking action to deny, revoke or suspend <br />a registration for any circumstance(s) which were not made known to the City during the <br />process set forth in Paragraph 2(B)(1), above, or which occur following the City <br />Manager's decision pursuant to Paragraph 2(B)(1), above, to issue a registration. <br />C. As used in these regulations, the phrase "City Manager" shall mean the City Manager <br />for the City of Charlottesville and/or his designee. The phrase "Chief of Police" shall mean the <br />Chief of Police for the Charlottesville Police Department and/or his designee. <br />City ager <br />/day H/ 1997 <br />Date <br />0 <br />
