(f) The director of recreation and leisure services is hereby authorized, with the <br />approval of the city manager, to promulgate rules and regulations governing the <br />time, place and manner in which city parks and other recreation facilities may be <br />used for special events, community events (as defined within Section 28-29(c) of <br />the city code) and for other activities, and to establish reasonable fees and rentals <br />therefor. A violation of any of the rules and regulations established hereunder <br />shall constitute a Class 4 misdemeanor. <br />CHAPTER 28. STREETS AND SIDEWALKS <br />Article I. In General <br />Sec. 28-5. Temporary street closings generally. <br />(a) The city manager may issue a permit for, direet the temporary elesing of, use of <br />any street to traifie for <br />ftmetion or other outdoor aetivity other than public purposes, and may close the <br />rights-of-way to public use and travel during such temporary use, for a specified <br />period of time, not to exceed forty-eight (48) hours, when he determines that such <br />temporary closing will not be unduly injurious to the safety and convenience of <br />the general public, that such closing is necessary because the event will impede <br />traffic and/or pedestrian travel, and that, where any rights-of-way to be closed are <br />extensions of the state primary highway system, adequate provision can be made <br />to detour through traffic. Such temporary use shall be conditioned upon the <br />temporary user's compliance with the following conditions: <br />No matter advertising any thing or business shall be displayed in or on the <br />public rights-of-way in connection with such temporary use; and <br />(2) The person so permitted to use the public rights-of-way shall furnish a <br />public liability and property damage insurance contract insuring the <br />liability of such person, firm, association, organization or corporation for <br />personal injury or death, and for damages to property, resulting from such <br />temporary use, in such amounts as shall be determined by the city <br />manager. The city shall be named as an additional insured in the insurance <br />contract. <br />The city manager is authorized to promulgate regulations, including the <br />establishment of reasonable fees, charges and insurance coverages, for the <br />temporary use of public rights-of-way as authorized by this section. <br />Prepared by Lisa R.
