SECTION VIII. Should the Company install any overhead lines, it shall have the <br />• authority to trim trees upon or overhanging the streets, alleys, walkways or rights-of-way to <br />prevent the branches of such trees from interfering with its lines or other facilities. However, all <br />such trimmings shall be performed in a safe and orderly manner and in compliance with the <br />pruning standards of the National Arborists Association as currently in effect. <br />SECTION IX. The term of this franchise shall be for a period of five (5) years from the <br />effective date of this ordinance. If the Company wishes to maintain its equipment within the City <br />and to continue the operation of the system, it shall give written notice to the City at least ninety <br />(90) days before expiration of the franchise, stating that it wishes to apply for a new franchise. <br />Such application shall include a comprehensive report of the status of the Company's system <br />within the City, any plans for alteration, expansion or improvement of the system, and a <br />statement as to whether the Company has complied with the provisions of this ordinance. The <br />City may grant the Company a new franchise if it determines that there has been substantial <br />compliance with the material provisions of this ordinance, and there is no other good cause why <br />the Company should not be granted a new franchise. Any new franchise shall be granted upon <br />such terms and conditions as the City Council of Charlottesville deems reasonable and <br />appropriate. If a new franchise is not granted to the Company, the City may require the Company <br />to remove all lines, cables and equipment from the City streets and rights-of-way at the <br />Company's own expense, within six (6) months after the expiration of this ordinance. <br />SECTION X. Nothing in this franchise shall be construed to mean that this is an <br />• exclusive franchise, as the City Council reserves the right to grant additional telephone franchises <br />to other parties. <br />SECTION XL All ordinances and parts of ordinances in conflict herewith are repealed. <br />SECTION XII.
