SECTION VIII. Should the Company install any overhead lines, it shall have the • authority to trim trees upon or overhanging the streets, alleys, walkways or rights-of-way to prevent the branches of such trees from interfering with its lines or other facilities. However, all such trimmings shall be performed in a safe and orderly manner and in compliance with the pruning standards of the National Arborists Association as currently in effect. SECTION IX. The term of this franchise shall be for a period of five (5) years from the effective date of this ordinance. If the Company wishes to maintain its equipment within the City and to continue the operation of the system, it shall give written notice to the City at least ninety (90) days before expiration of the franchise, stating that it wishes to apply for a new franchise. Such application shall include a comprehensive report of the status of the Company's system within the City, any plans for alteration, expansion or improvement of the system, and a statement as to whether the Company has complied with the provisions of this ordinance. The City may grant the Company a new franchise if it determines that there has been substantial compliance with the material provisions of this ordinance, and there is no other good cause why the Company should not be granted a new franchise. Any new franchise shall be granted upon such terms and conditions as the City Council of Charlottesville deems reasonable and appropriate. If a new franchise is not granted to the Company, the City may require the Company to remove all lines, cables and equipment from the City streets and rights-of-way at the Company's own expense, within six (6) months after the expiration of this ordinance. SECTION X. Nothing in this franchise shall be construed to mean that this is an • exclusive franchise, as the City Council reserves the right to grant additional telephone franchises to other parties.
