• Sec. 34-901. Authority. <br />Site plans for projects within the Transition Zone District must be reviewed by the <br />Planning Commission. Such plans may not be approved administratively. All other site plans <br />may be approved administratively by the director of neighborhood planning and development <br />services, or his designee _-planning and eemmttnity development, after first circulating the plan to <br />the various city departments for written comments, if any, and notifying such members of the <br />planning commission who have expressed in writing a desire to be so notified, that the site plan <br />is being circulated. Such notification shall describe the area, location and the proposed use or <br />activity. However, in cases of disagreement or public interest, the applicant, the director of <br />neighborhood planning and development services planning and etittimunity development, or the <br />chairman of the planning commission or any two (2) members of the planning commission may <br />require that the site plan be reviewed by the planning commission. <br />Sec. 34-902. Preapplication conference. <br />(a) ... <br />(b) ... <br />(c) The conference shall be open to the public. No published notice is required; however, the <br />department of neighborhood planning and development services <br />development shall send written notice of the time, date, place and subject of such <br />conference to the applicant or his agent and to the owner or agent for the owner of each <br />• property abutting or immediately across a street or road from the property subject to site <br />plan review, and to the neighborhood association(s), if any, for the neighborhood adjacent <br />to the property ject to site plan review. Notice sent by first class mail to the last <br />known address of such owner or agent as shown on the current real estate tax assessment <br />books, postmarked not less than five (5) days before the conference, shall be deemed <br />adequate.
