• CONTRACT FOR THE SALE/PURCHASE OF REAL ESTATE
<br />THIS CONTRACT is made as of the 22nd day June, 1999, between the CITY OF
<br />CHARLOTTESVILLE, VIRGINIA, a political subdivision of the Commonwealth of Virginia,
<br />Grantor, hereinafter referred to as "SELLER,"and CHARLES WM. HURT and SHIRLEY L.
<br />FISHER, as Trustees for the Burnet Land Trust, pursuant to the terms of a land trust
<br />agreement dated June 15, 1984, Grantee, hereinafter referred to as "PURCHASER," whose
<br />address is P.O. Box 8147, Charlottesville, Virginia, 22906.
<br />WITNESSETH:
<br />WHEREAS, Seller is the owner of certain real property situated in the City of
<br />Charlottesville, Virginia, designated on a plat made by B. Aubrey Huffman and Associates, Ltd.,
<br />dated March 2, 1999 (the "Plat"), a copy of which is attached hereto, as Lot B, zoned "R-3",
<br />containing approximately 35,933 square feet, and Lot C, zoned "R-3", containing approximately
<br />27,681 square feet, for an aggregate of 63,614 square feet, or 1.46 acres;
<br />WHEREAS, together with other lots, said Lots B and C are also depicted on a certain
<br />December, 1996 sketch of development activity to occur on Lot B, Lot C and properties adjacent
<br />thereto, a copy of which is attached hereto titled "Sketch Plat";
<br />• WHEREAS, Seller has agreed to sell aportion of the above described property to Purchaser
<br />and Purchaser has agreed to purchase the property from Seller for the purchase price of Forty One
<br />Thousand Five Hundred Twenty Three and 00/100 Dollars ($41,523.00) Forty Seven Thatt

<br />NOW THEREFORE, in consideration of the premises and the mutual covenants contained
<br />herein, Seller and Purchaser do hereby set forth their agreement as follows:
<br />I. AGREEMENT TO SELL/PURCHASE
<br />Seller agrees to sell to Purchaser, and Purchaser agrees to purchase from Seller, the real
<br />property referred to herein as the Property, which is more particularly described as follows, to -wit:
<br />All that certain tract or parcel of land, with the improvements thereon and the
<br />appurtenances thereto belonging, situated in the City of Charlottesville, Virginia,
<br />containing approximately 63,614 square feet of area, and shown on the Plat as Lot B
<br />and Lot C less and except Lot 36 shown on the Sketch Plat; being a portion of the
<br />same property in all respects conveyed to the City of Charlottesville, Virginia, by
<br />deed dated October 13, 1944, of record in the Charlottesville Circuit Court Clerk's
