Approved by City Council on May 1, 2000 <br />AN ORDINANCE <br />• CLOSING, VACATING AND DISCONTINUING <br />PORTIONS OF SADLER STREET AND AN ADJOINING ALLEY. <br />WHEREAS, proper notice was duly posted and advertised that Keith Woodard would <br />request the City Planning Commission to initiate street closing procedures to close a portion of <br />Sadler Street east of 14" Street, N.W. and a portion of an adjoining alley, said Sadler Street right-of- <br />way being approximately 30 feet in width and running a distance of approximately 151 feet from 14`" <br />Street, N.W. to a 10 foot wide alley running approximately 200 feet south of Sadler Street, shown <br />on the attached map drawn by the City Neighborhood Planning & Development Services <br />Department; <br />WHEREAS, owners along those portions of Sadler Street and the alley to be closed have <br />been duly notified; <br />WHEREAS, a joint public hearing by the Planning Commission and City Council was held <br />on March 14, 2000, and comments from the City staff, the Planning Commission and the public were <br />made and heard; and <br />WHEREAS, the Planning Commission recommended closure of the subject street right-of- <br />way and the alley, with a recommendation to Council that the applicant pay fair market value for the <br />closed right-of-way; and <br />WHEREAS, pursuant to Virginia Code §15.2-2008 City staff and Keith Woodard have <br />agreed to a purchase price of $15,000 for the subject right-of-way, conditioned on City Council <br />approval; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that a portion of <br />the Sadler Street right-of-way, a dedicated but unopened street, and a portion of the adjoining 10 foot <br />alley, described as follows, are hereby closed, vacated and discontinued as public thoroughfares of <br />the City of Charlottesville, Virginia, said street right-of-way and alley not being needed for public <br />use and travel: <br />Public right-of-way known as Sadler Street in the City of <br />Charlottesville, approximately 30 feet in width and running a distance <br />of approximately 151 feet east of 141" Street, N.W., and a portion of <br />an adjoining 10 foot wide alley running approximately 200 feet south <br />of the above -referenced Sadler Street right-of-way, shown on the <br />attached map drawn by the City Community Development <br />Department, and located on City Real Estate Tax Map 4 adjacent to <br />Parcels 291, 292 and 302. <br />PROVIDED, HOWEVER, that the City of Charlottesville hereby reserves unto itself a <br />perpetual easement ten feet in width on either side of the center line of any water, gas, sanitary or <br />• <br />storm sewer mains presently located in the area being vacated, including the perpetual right of <br />ingress and egress over the vacated area for the purpose of installing, maintaining, repairing or <br />replacing such utility lines or mains. <br />
