AN ORDINANCE <br />• AUTHORIZING THE CONVEYANCE OF A SANITARY SEWER EASEMENT <br />IN PENN PARK LANE TO THE CATHOLIC DIOCESE OF RICHMOND AND <br />THE ALBEMARLE COUNTY SERVICE AUTHORITY <br />WHEREAS, the Catholic Diocese of Richmond, on behalf of the Charlottesville Catholic <br />School, has requested this Council to grant a sanitary sewer line easement across Penn Park Lane, <br />as shown on the attached plat; and <br />WHEREAS, after installation of the sanitary sewer line, the Albemarle County Service <br />Authority is prepared to accept the line into its system for future maintenance; and <br />WHEREAS, Engineering Division and Parks Division staff have reviewed the plans and <br />have no objection to the easement being granted in that location; and <br />WHEREAS, installation of the sanitary sewer line will not affect operation or use by the <br />public of Pen Park; and <br />WHEREAS, the City and the Catholic Church are finalizing negotiations related to <br />obligations that the Church will assume in consideration for the City's conveyance to the Church of <br />a temporary construction easement across Pen Park; now, therefore <br />• BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the Mayor <br />is hereby authorized to execute a quitclaim deed of easement, in form approved by the City Attorney, <br />granting the above-described sanitary sewer line easement in Penn Park Lane to the Catholic Diocese <br />of Richmond and the Albemarle County Service Authority; provided, however, that the executed <br />quitclaim deed shall not be delivered to the Catholic Diocese or the Albemarle County Service <br />Authority unless and until negotiations related to a temporary construction easement in Pen Park <br />have been satisfactorily completed, as determined by the City Attorney. <br />Approved by Council <br />C:\Mypiles\Council\catholic sewer cas.ord.wpd November 20, 2000 <br />C,146rk of City Council <br />1J <br />
