LEASE AGREEMENT <br />THIS LEASE AGREEMENT, made this 20'h day of September, 2000, by and <br />between the CITY OF CHARLOTTESVILLE, VIRGINIA, a municipal corporation, herein <br />referred to as "City," and Marcus Jones, d.b.a. City News, Grantee, herein referred to as <br />"Tenant," whose address is 290 Albert Court, Charlottesville, Virginia 22901. <br />(1) LEASE OF PREMISES: The City hereby leases to the Tenant, and the <br />Tenant hereby leases from the City, all surface lands and rights thereto in that certain <br />area of land containing approximately 100 square feet and situated on the Downtown <br />Mall between 15' and 2nd Streets, Charlottesville, Virginia, which property currently is the <br />situs of a structure referred to as a kiosk. <br />(2) TERM: The Term of this lease shall be one (1) year, beginning on October 1, <br />2000, (the "Commencement Date") and ending on September 30, 2001, with the terms <br />to be renegotiated after the first year. <br />(3) RENT: The Tenant shall pay to the City a monthly rent of Fifty Dollars <br />($50.00), payable the first of themonth in advance, with the rate to be negotiated after <br />the first year. <br />(4) USE: The Tenant shall be responsible for conducting or obtaining an <br />individual or business to conduct retail sales at the kiosk (the "Occupant"). No food, <br />• other than prepackaged snacks, will be prepared or sold from the kiosk. The Tenant's <br />selection of the Occupant shall be subject to the prior approval of the City. <br />The Tenant shall require the Occupant to maintain and display in a prominent <br />location in the kiosk all tourist materials and informational brochures and literature <br />provided by the Charlottesville -Albemarle Visitors Bureau, the City of Charlottesville, <br />Downtown for the Holidays, the Charlottesville Downtown Foundation and other such <br />organizations as may from time to time be approved by the Director of the <br />Charlottesville Department of Economic Development at no cost to the Tenant or the <br />Occupant. Said materials shall be displayed separately from any merchandise offered <br />for sale by the Occupant and shall be distributed upon request and without charge to <br />members of the public who stop at the kiosk. The Occupant shall promptly notify the <br />City whenever the tourist information and brochures need to be re -supplied. <br />The kiosk must be kept open and manned seven days a week from the hours of <br />8:00 a.m. to 6:00 p.m. or only as otherwise approved by the Director of the <br />Charlottesville Department of Economic Development. <br />(5) TAXES: The Tenant shall require the Occupant to pay, as and when they <br />become due, all taxes and utilities associated with the use of the kiosk (including any <br />business license taxes required). <br />0 <br />
