(6) UTILITIES: After the Commencement Date and during the term of this Lease, <br />the Tenant shall pay, or cause the Occupant to pay, all ongoing charges for the <br />• electricity and any other utilities provided to the kiosk. The City makes no representation <br />regarding the availability of any particular utility at the site of the kiosk, and will not be <br />responsible for any costs associated with the provision of any utility service to the kiosk. <br />(7) ASSIGNMENT AND SUBLETTING: The Tenant shall prohibit the Occupant <br />from assigning any rights granted under or through this Lease, or subletting the kiosk or <br />any portion thereof. <br />(8) ALTERATIONS: Neither the Tenant nor the Occupant shall make any <br />alterations or renovations to the structure or the appearance of the kiosk without the <br />prior written approval of the City. <br />(9) SIGNAGE: Any signs to be installed by the Tenant or Occupant shall be <br />approved in advance by the City through its Department of Economic Development <br />and/or Board of Architectural Review. <br />(10) MAINTENANCE: The Tenant shall require the Occupant to maintain the <br />kiosk in a neat and clean condition at all times. Trash and refuse shall be promptly <br />removed from the kiosk and disposed of in a lawful manner. <br />(11) INSURANCE AND INDEMNIFICATION: The Tenant shall require the <br />• Occupant at all times during the term of this Lease to keep in full force and effect a <br />policy of public liability and property damage insurance with respect to the kiosk and <br />any business conducted thereon, with a combined single limit of liability of not less than <br />$1,000,000 (combined single limit) for public liability and property damage. Such policy <br />shall be endorsed to name the City of Charlottesville as an additional insured, and shall <br />not be canceled without fifteen (15) days prior notice to the City. This Lease shall not <br />become effective unless and until a certificate evidencing such insurance is submitted to <br />and approved by the City. <br />The Tenant and the Occupant shall indemnify and hold harmless the City and its <br />officets and employees against any expense, loss, costs and damages, including <br />attorney's fees, arising out of any breach or default by the Tenant or the Occupant of <br />any provision of this Lease, or that are the result of the Occupant's use or occupancy of <br />the kiosk. <br />(12) LEASE TERMINATION: The City and the Tenant shall each have the right to <br />terminate this Lease upon sixty (60) days prior written notice to the other party. The City <br />shall have the additional right to immediately terminate this Lease if the Tenant or the <br />Occupant breaches any provision of this Lease and fails to cure such breach within <br />thirty (30) days after written notice is sent to the Tenant by the City. <br />(13) SURRENDER OF PREMISES: At the end of the term of this Lease or upon <br />• its termination the Tenant and the Occupant shall surrender the kiosk and any <br />
