0 <br />Approved by City Council on December 17, 2001 <br />AN ORDINANCE <br />AMENDING AND REORDAINING SECTION 4-41 OF CHAPTER 4 <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, <br />RELATING TO THE LEASH LAW FOR DOGS. <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that <br />Section 4-41 of Article II, of Chapter 4 of the Charlottesville City Code, 1990, as <br />amended, is hereby amended and reordained as follows: <br />Sec. 4-1. Violations of chapter. <br />Unless otherwise specifically provided, a violation of any provision of this chapter shall <br />constitute a Class 1 misdemeanor. <br />See. 4-2. Definitions. <br />The following words, terms and phrases, when used in this chapter, shall have the <br />meanings ascribed to them in this section, except where the context clearly indicates a <br />different meaning: <br />• Animal warden means any person swom as such officer by the chief of police. <br />Cat means every cat, regardless of sex or age. <br />Dog means every dog, regardless of sex or age. <br />Leash means a physical restraint made of leather, chain, rope, or other reasonably strong <br />material, which is securely attached to a dog's collar or harness and which is intended to <br />be held by an owner of a dog or attached to an immovable object. <br />Owner means every person having right of property or custody in an animal or who keeps <br />or harbors an animal or has it in his care. <br />To run at large or running at large means to roam, loiter, walk, run or be on or off the <br />premises of the owner without being fenced, caged, physically carried, held by leash by a <br />person thoroughly capable both physically and mentally of controlling the animal, or <br />within the immediate voice control of the owner. <br />Sec. 4-38. Running at large. <br />It shall be unlawful for the owner of any dog to allow such dog to run at large, at any <br />time within the city, even though the dog is both lawfully licensed and vaccinated.
