(2) Purchases of precious metals or gems directly from a duly qualified <br />fiduciary who is disposing of the assets of an estate being administered by such <br />fiduciary. <br />• (3) Acceptance by a retail merchant of trade-in merchandise previously sold <br />by such retail merchant to the person presenting that merchandise for trade-in. <br />(4) Repairing, restoring or designing jewelry by a retail merchant, if such <br />activities are within the normal course of such merchant's business. <br />(5) Purchases of precious metals or gems by industrial refiners and <br />manufacturers insofar as such purchases are made directly from retail <br />merchants, wholesalers or dealers, or by mail originating outside the city. <br />(6) Regular purchasing and processing of nonprecious scrap metals which <br />incidentally may contain traces of precious metals recoverable as a by-product. <br />Fixed and permanent location means a single location within the city where a <br />person will engage in the activities of a dealer for thirty (30) or more days in a <br />calendar year. <br />Gems means any item containing or having any precious or semiprecious stones <br />customarily used in jewelry or ornamentation. <br />Person means and includes any individual, corporation, partnership, association. <br />• company, business, trust, joint venture or other legal entity. <br />Precious metals means any item, except a coin, containing as part of its <br />composition in any degree gold, silver, platinum or pewter. <br />Sec. 21-32. Notice of closing and reopening of business; location of <br />business. <br />ulf the business of a dealer conducting business at a fixed and permanent <br />location is not operated without interruption, Saturdays, Sundays and recognized <br />holidays excepted, the dealer shall notify the chief of police of all closings and <br />reopenings of the business at that location. The business of such dealer shall be <br />conducted only from the fixed and permanent location specified in his application <br />for a permit under division 2 of this article. <br />(b)A person who conducts the business of a dealer at any location other than a <br />fixed and permanent location shall conduct such activities only from the location <br />specified in his application for a permit under division 2 of this article. <br />11 <br />
