or "hazardous wastes" (as defined by the Resource Conservation Act, 15 U.S.C. Section 2601 <br />• et seq., as amended). <br />Grantee further acknowledges that the City makes no guarantee, representation or <br />warranty regarding the condition of the premises, and the City expressly disclaims any and all <br />obligation and liability to Grantee regarding any physical or environmental defects which may <br />exist with respect to the property herein conveyed. <br />The parties agree that the conditions set forth in Sections 6, 7 and 8 of an agreement <br />between the City and Piedmont dated July 1, 2000, which were applicable to other real estate <br />owned by Piedmont and located adjacent to the Property, shall also apply mutatis mutandis to the <br />subject Property, or any portion thereof. Such conditions, as set forth below, are hereby <br />incorporated in this deed, and shall run with the land and be binding upon Grantee's successors <br />in title and assigns: <br />• 1. Prior to the start of construction of any new single family home, Piedmont shall, <br />at its sole cost and expense, prepare for submission to the City elevations of the <br />site with detailed specifications regarding all exterior features of the home. <br />Construction shall not begin until the City Manager, or his designee, has reviewed <br />the plans and granted Piedmont architectural design approval. Piedmont agrees <br />that no changes shall be made in the approved plans without the written consent <br />of the City Manager or his designee. <br />The City agrees that it will promptly consider and decide any requests by <br />Piedmont for architectural design approval or for changes in the approved design. <br />If the initial architectural design submitted by Piedmont is not approved, the City <br />Manager or his designee, will make recommendations for changes in the design <br />which will enable Piedmont to obtain approval. Any such recommendations shall <br />take into consideration the amount of funds which Piedmont has available to <br />perform the work. <br />2. Upon completion of the work described herein Piedmont agrees that it will cause <br />the Property to be marketed for sale to a single family who intends to occupy the <br />premises as their primary residence. <br />is Page 2 <br />
