• AN ORDINANCE <br />AMENDING AND REORDAINING SECTION 34-731 . <br />CHAPTER 34, ARTICLE XIX, DIVISION 2 <br />(ACCESS TO STREET OR ALLEY; PARKING NEAR BUILDING <br />ENTRANCES; PARKING WITHIN SETBACKS) <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />AS AMENDED <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that <br />Section 34-731 of Chapter 34, Article XIX, Division 2 of the Charlottesville City Code, <br />1990, as amended, is hereby amended and reordained as follows: <br />Sec. 34-731. Access to street or alley; parking near building entrances; parking <br />within setbacks. <br />Off-street automobile or vehicular parking spaces required by this article shall have adequate <br />access to a street or alley, and such access and spaces shall not thereafter be reduced or <br />encroached upon. No vehicle shall be parked within six (6) feet of any entrance or exit to a <br />building. Any parking, required or otherwise, within required setbacks shall be subject to the <br />following regulations: <br />• (1) Improved parking for up to three (3) vehicles for single-family attached or detached or <br />two-family dwellings, or attached dwellings up to two (2) dwellings, may be located within the <br />required front, side and rear yard setbacks; provided, that no more than twenty-five (25) percent <br />or eighteen (18) feet of the front yard street frontage, whichever is greater, shall be improved for <br />parking; <br />(2) Parking for multi -family dwellings and nonresidential uses allowed in residential districts <br />shall not be located within the required front or side yard setbacks, however, such parking may <br />be located in the rear yard; <br />(3) Parking in all business and industrial districts shall not be within the required front yard <br />setback, however, such parking may be located in the side or rear yard setbacks, <br />however, dealers in motor vehicles may display such vehicles in the required front yard. <br />(b) In the city's R-1, R -IA and R-2 zonine districts, use of property as access to any multi- <br />family, commercial or industrial use or development shall be permitted only with a special <br />use permit obtained in accordance with the procedures and provisions of Article XXII <br />(Special Permits) of this Chapter. <br />Approved by Council <br />March 19, 2001 <br />0J_&tk of City Cou cil <br />
