Building Code Adopted . <br />(a) There is hereby incorporated by reference into this Code <br />ME 1701"Me I Ne— the Virginia Uniform Statewide Building Code <br />("USBC") adopted and promulgated on April 15, 1997 by the Virginia Board of Housing and Community <br />thereof and regulations promulgated pursuant thereto, as adopted and promulgated by such Board from <br />time to time (including, without limitation, the USBC Amendment adopted by the Board effective <br />September 15, 2000, and any documents or codes adopted and incorporated into the USBC by reference <br />therein . For the <br />purposes of this chapter the term "building department" shall mean the city's department of <br />neighborhood development services. which is hereby charged with the administration, supervision and <br />• enforcement of the USBC and with approval of plans, inspection of buildings and issuance of permits, <br />licenses, certificates or similar documents. <br />(c) The code adopted by this chapter is hereby declared to be remedial, and shall be construed to secure <br />the beneficial interests and purposes thereof, which are public safety, health and general welfare, through <br />structural strength, stability, sanitation, adequate light and ventilation, and safety to life and property from <br />fire and other hazards incident to the construction, alteration, repair, removal, demolition, use and <br />(d) The provisions of the code adopted by this chapter shall apply to the construction, alteration, repair, <br />equipment, use and occupancy, location, maintenance, removal and demolition of every building or <br />structure or any appurtenances connected or attached to such buildings and structures. <br />(e) Except as otherwise provided, any owner or other person who shall violate any provision of the USBC <br />or who shall violate any lawful provision of any rule, regulation or order adopted or made by the building <br />code official pursuant to the provisions of this Article II shall be guilty of a misdemeanor punishable by a <br />fine of not more than two thousand five hundred dollars ($2,500.00). Each day a violation continues after <br />conviction shall constitute a separate offense. If the violation remains uncorrected at the time of the <br />conviction, the Court shall order the violator to obey or remedy the violation in order to comply with the <br />provisions of this Article Il. Except as otherwise provided by the Court for good cause shown, any such <br />violator shall abate or remedy the violation within six (6) months of the date of conviction. Each day <br />during which a violation continues after the court-ordered abatement period has ended shall constitute a <br />separate offense. Any person convicted of a second offense committed within less than five years after a <br />first offense shall be punished by a fine of not less than $1,000 nor more than $2,500. Any person <br />convicted of a second offense committed within a period of five to ten years of a first offense shall be <br />• punished by a fine of not less than $500 nor more than $2,500.
