AN ORDINANCE <br />• AUTHORIZING THE ABANDONMENT OF AN EASEMENT <br />RESERVED BY ORDINANCE ADOPTED APRIL 16, 2001 <br />LOCATED IN THE VACATED PORTION OF THE <br />DELEVAN STREET RIGHT-OF-WAY <br />• <br />• <br />WHEREAS, the owner of property designated as Parcel 34 on City Real Estate Tax Map <br />30 has requested abandonment by the City of a 20 foot wide utility easement in that portion of <br />the Delevan Street right-of-way closed and vacated by City Council on April 16, 2001, as shown <br />on the attached plat by Gary M. Whelan last revised June 7, 2000; and <br />WHEREAS, the Assistant City Engineer and the Gas Division Manager have confirmed <br />that there are no existing City utilities within the easement area reserved under the ordinance <br />adopted April 16, 2001; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the <br />Mayor is hereby authorized to execute a Deed of Abandonment of Easement, in form approved <br />by the City Attorney, abandoning and vacating the utility easement reserved by the City by the <br />ordinance closing a portion of the Delevan Street right-of-way adopted April 16, 2001. <br />Approved by Council <br />December 16, 2002 <br />iC <br />lek of City Cou cit <br />
