AN ORDINANCE <br />• AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED <br />IN SECTION 34-15 OF THE ZONING ORDINANCE <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />AS AMENDED, BY THE RE -ZONING OF PORTIONS OF PARCELS 106, 107, <br />107.2 (formerly part of 107.1), and I ILA (formerly part of parcels 110 AND 111), <br />OF THE 2002 CITY TAX MAP 54, <br />FROM 11R-2" TO "R-3" <br />WHEREAS, the Owner of Parcels 106, 107, 107.2, 11 LA (formerly part of parcels 110 <br />and 111), located on 2002 City Tax Map 54, has submitted an application seeking a rezoning of <br />portions of each of those Parcels from "R-2 Residential District" to "R-3 Multiple Residential <br />Dwelling District", (hereinafter, the "Proposed Rezoning"); and <br />WHEREAS, ajoint public hearing on this application was held before the City Council <br />and Planning Commission on February 12, 2002, following notice to the public and to adjacent <br />property owners as required by law; and <br />WHEREAS, on February 12, 2002 the Planning Commission voted to recommend the <br />Proposed Rezoning; and <br />WHEREAS, this Council finds and determines that the public necessity, convenience, <br />general welfare or good zoning practice requires the Proposed Rezoning; that both the existing <br />"R-2" zoning and the proposed "R-3" zoning classifications are reasonable; and that the <br />Proposed Rezoning is consistent with the concept and purpose of the City Code, Chapter 34, <br />Article VI; Now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the <br />District Map Incorporated in Section 34-15 of the Zoning Ordinance of the Code of the City of <br />Charlottesville, 1990, as amended, be and hereby is amended and reenacted as follows: <br />Section 34-15. Zoning District Map. <br />Rezoning from R-2 Residential to R-3 Multiple Residential Dwelling District portions of <br />the properties identified as Parcels 106, 107, 107.2 and I I LA on the City's 2002 Real Estate Tax <br />Map 54, having (collectively) approximately 50 feet of frontage on 11'h Street, N.W., and <br />containing approximately 12,329 square feet (SF), or approximately 0.28 acres, of land, as <br />follows: <br />7,419 SF of TM 54-11 I.A (formerly a part of TM 54-110 (3,000SF) and 54-111(4,419 SF)) <br />720 SF of TM 54-107 <br />720 SF of TM 54-107.2 (formerly a part of TM 54-107.1) <br />3,470 SF of TM 54-106 <br />• Approved by Council tit�k 2� <br />March 18, 2002 le k of City Council <br />
