AN ORDINANCE • AMENDING AND REENACTING ARTICLE XVIII -A (ENTRANCE CORRIDOR HISTORIC (ECH) OVERLAY DISTRICT), SECTION 34-671 (APPLICABILITY) OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, TO DESIGNATE A PORTION OF MCINTIRE ROAD AS AN ENTRANCE CORRIDOR OVERLAY DISTRICT WHEREAS, the staff of the City's Department of Neighborhood Development Services has initiated an application seeking an amendment of the City's zoning ordinance, to designate and add a portion of McIntire Road, from Preston Avenue to the Route 250 Bypass, to the list of arterial streets and highways included within the City's Entrance Corridor Overlay Districts (hereinafter, the "Proposed Amendment"); and WHEREAS, ajoint public hearing on this application was held before the City Council and Planning Commission on February 12, 2002, following notice to the public and to adjacent property owners as required by law; and WHEREAS, on February 12, 2002 the Planning Commission voted to recommend the Proposed Amendment; and WHEREAS, this Council finds and determines that McIntire Road, from Preston Avenue' to the Route 250 Bypass, classified an urban minor arterial street, is a significant route of tourist • access to the City and to historic landmarks, buildings, structures or districts of the City; and WHEREAS, this Council finds and determines that the public necessity, convenience, general welfare or good zoning practice requires the Proposed Amendment and that the Proposed Amendment is consistent with the purpose and intent of the City Code, Chapter 34, Article XVIII -A; Now, therefore, BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the District Map Incorporated in Section 34-15 of the Zoning Ordinance of the Code of the City of Charlottesville, 1990, as amended, be and hereby is amended and reenacted as follows: Section 34-671. Applicability. The provisions of this article shall apply to the Entrance Corridor historic (ECH) Overlay Districts, which shall include all land contiguous to the following arterial streets or highways: (12) McIntire Road from Preston Avenue to the 250 Bypass. As used herein, the term "contiguous" shall mean land which is both (i) within one hundred (100) feet of the streets and highways listed above and (ii) part of a parcel which abuts such streets and highways. • Approved by Council �i March 18, 2002 C1 J of City Council
