AN ORDINANCE <br />• AMENDING AND REENACTING ARTICLE XVIII -A (ENTRANCE CORRIDOR <br />HISTORIC (ECH) OVERLAY DISTRICT), SECTION 34-671 (APPLICABILITY) OF <br />THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />AS AMENDED, TO DESIGNATE A PORTION OF MCINTIRE ROAD AS AN <br />ENTRANCE CORRIDOR OVERLAY DISTRICT <br />WHEREAS, the staff of the City's Department of Neighborhood Development Services <br />has initiated an application seeking an amendment of the City's zoning ordinance, to designate <br />and add a portion of McIntire Road, from Preston Avenue to the Route 250 Bypass, to the list of <br />arterial streets and highways included within the City's Entrance Corridor Overlay Districts <br />(hereinafter, the "Proposed Amendment"); and <br />WHEREAS, ajoint public hearing on this application was held before the City Council <br />and Planning Commission on February 12, 2002, following notice to the public and to adjacent <br />property owners as required by law; and <br />WHEREAS, on February 12, 2002 the Planning Commission voted to recommend the <br />Proposed Amendment; and <br />WHEREAS, this Council finds and determines that McIntire Road, from Preston Avenue' <br />to the Route 250 Bypass, classified an urban minor arterial street, is a significant route of tourist <br />• access to the City and to historic landmarks, buildings, structures or districts of the City; and <br />WHEREAS, this Council finds and determines that the public necessity, convenience, <br />general welfare or good zoning practice requires the Proposed Amendment and that the Proposed <br />Amendment is consistent with the purpose and intent of the City Code, Chapter 34, Article <br />XVIII -A; Now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the <br />District Map Incorporated in Section 34-15 of the Zoning Ordinance of the Code of the City of <br />Charlottesville, 1990, as amended, be and hereby is amended and reenacted as follows: <br />Section 34-671. Applicability. <br />The provisions of this article shall apply to the Entrance Corridor historic (ECH) Overlay <br />Districts, which shall include all land contiguous to the following arterial streets or highways: <br />(12) McIntire Road from Preston Avenue to the 250 Bypass. <br />As used herein, the term "contiguous" shall mean land which is both (i) within one <br />hundred (100) feet of the streets and highways listed above and (ii) part of a parcel which abuts <br />such streets and highways. <br />• <br />Approved by Council �i <br />March 18, 2002 C1 J of City Council <br />
