• AN ORDINANCE AMENDING AND RE -ORDAINING <br />THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, <br />CHAPTER 28 (STREETS AND SIDEWALKS), ARTICLE VI (SIDEWALK CAFES) <br />WHEREAS, the City Council desires to create more efficient procedures for issuing <br />permits authorizing outdoor cafes on the Downtown Pedestrian Mall and other public property <br />within the City, and to update existing rules and standards for such permits; And <br />WHEREAS, this Council finds and determines that the amendments set forth within this <br />ordinance will serve the public welfare, safety and convenience by achieving a fair process for <br />allowing outdoor cafes, which contribute to the attractiveness and economic welfare of the City, <br />while preserving the convenience and accessibility of the City's pedestrian walkways; <br />WHEREAS, since ongoing studies may provide additional solutions for the equitable <br />allocation of caf6 space on the downtown mall, it is the intent of Council to re-examine this <br />ordinance on or before March 1, 2004, and any date thereafter, and therefore, no rights or <br />privileges shall vest in any permit holder beyond the term of any permit issued hereunder. <br />NOW, THEREFORE, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that Sections <br />• 28-186 through 28-216, Article VI, Chapter 28 of the Charlottesville City Code, 1990, as <br />amended, is hereby amended and re -ordained as follows: <br />DIVISION 1. GENERALLY <br />Sec. 28-186. Responsibilities of zoning administrator under article. <br />The zoning administrator shall be responsible for receiving and approving applications for permits <br />under this article and for <br />administerine the requirements of this article. <br />Sec. 28-187. Compliance with state and local laws and regulations. <br />Oa The operation of a cafe pursuant to a permit granted under this article shall comply with all <br />provisions of state and local building codes and health laws and regulations regarding the service <br />and preparation of food and also, where applicable, the operations of an outdoor cafe shall be <br />conducted in accordance with the regulations of the state alcoholic beverage control board. <br />(b)No person operating a cafe under a permit granted under this article shall allow any cafe <br />furnishings or equipment to be or remain within any fire lane, or to protrude into the airspace <br />above any fire lane. <br />0 <br />
