shall be let to applicants on a first—come, first-served basis. <br />• (1)No operator shall be assigned all the available space within a single block on the downtown <br />mall No space in excess of eight hundred (800) square feet will be assigned to any operator. <br />This paragraph shall not affect pace initially reserved to any operator under a permit issued prior <br />to November 30, 2001. <br />(2)In assigning outdoor cafe locations on the downtown mall the zoning administrator shall <br />reserve a space at least six (6) feet wide between each cafe. <br />Sec. 28-213. Grant. <br />The "t-counoi zoning administrator may shall grant a permit applied for under this division for <br />a period of not more than five (5) one permit term year -s , provided it the zoning administrator <br />finds: <br />(1) That the proposed cafe will not unreasonably restrict the movement of pedestrian traffic <br />on the sidewalk or pedestrian mall, and that the outdoor cafe and all associated furnishings <br />equipment will not block any fire lane or protrude into the airspace above any fire lane. <br />(2) In the case of a cafe located on a sidewalk, that sufficient sidewalk width is available to <br />safely accommodate an outdoor cafe, without the cafe area will not occupying more than fifty <br />• (50) percent of the usable width of the sidewalk. <br />(3) That the restaurant requesting the permit is being or will be operated as a lawful pefnitted <br />use in the zoning district in which it is located. If the proposed cafe will be located in an area <br />subject to design control by the board of architectural review, once the city council zoning <br />administrator has approved the loeati completed an initial review of the application, then the <br />design and appearance of the cafe structures and furnishings shall be reviewed by the board <br />pursuant to the standards and procedures set forth in chapter 34 of this Code. <br />(4) That the proposed cafe will not present a hazard to the public health, safety or welfare. <br />Sec. 28-214. Contents and conditions generally. <br />(a)A permit granted by the -ity eeune i zoning administrator under this division shall ident' <br />establish the seasen permit term, or outstanding portion thereof, during which for the operation <br />of the cafe shall be authorized.
