In the event the permit holder's agreement <br />• and security deposit have not been received by the City on or before November 30, then the cafe <br />operator shall be required to vacate the area which is the subject of the permit and shall maintain <br />the area free of all equipment and furnishings through the last day of February of the succeeding <br />calendar year. <br />(1)ln the event the operator chooses to remain in operation through the winter months, but <br />fails to maintain his cafe area free of ice and snow, the City shall have the right to enter the <br />outdoor cafe space,take take action necessto remove ice and snow, and deduct the cost of <br />such action from the operator's security deposit. If the security deposit is insufficient to <br />cover the cost of removal the City shall bill the operator. The operator shall pay the bill <br />within thirty (30) dais. <br />(2)lf at any time during a permit term the balance of an operator's security deposit falls below <br />five hundred dollars ($500.00) the operator shall provide the city with an additional deposit in <br />an amount sufficient to restore the balance to $500.00. <br />(b)Permits for cafes on the Main Street downtown pedestrian mall may contain sueh additional <br />reasonable conditions and requirements as the eeuneil zoning administrator may deem necessary_ <br />The purpose of any such conditions shall be to ensure that the operation or use of the proposed <br />cafe will not present a hazard to the public health, safety or welfare their operation end <br />appearanee are eempatible with the atmespher-e of the mall. <br />• (c)Effective May 1, 1995 for the permit term commencing in March 2002, and each permit term <br />thereafter: <br />(1)Each applicant for a cafepermit shall pay Fent a permit fee of one hundred twenty-five dollars <br />($125.00), upon submission of such application. For operators renewing an existing permit this <br />fee shall be due and payable within thirty (30) days following the commencement of the current <br />permit term.
