AN ORDINANCE <br />• AMENDING AND REORDAINING CHAPTER 12 (FIRE PREVENTION AND <br />PROTECTION), ARTICLE III (FIRE PREVENTION CODE) <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />AS AMENDED, RELATING TO OPEN BURNING. <br />BE IT ORDAINED by the Council of the City of Charlottesville that Chapter 12, <br />Article III of the Code of the City of Charlottesville, 1990, as amended, is and shall <br />hereby be amended and re -ordained as set forth herein below: <br />Sec. 12-50. Definitions <br />For purposes of this article the following definitions shall apply: <br />(a) Garbage. Putrescible animal and vegetable matter accumulated by a household in the <br />course of ordinary day-to-day living, <br />(b) Household refuse. Waste material and trash normally accumulated by a household in <br />the course of ordinary day-to-day living, <br />(c) Open burning. The burning of any matter in such a manner that the resulting <br />products of combustion from the burning are emitted directly into the atmosphere <br />• without passing through a stack, duct or chimney. <br />(d) Refuse. Trash, rubbish, garbage and other forms of solid or liquid waste, including, <br />but not limited to, wastes resultant from residential, agricultural, commercial, <br />industrial, institutional, trade, construction, land cleaning, forest management, and <br />emergency operations. <br />Sec. 12-59. Open -burning e f fubbi w brush,et^ <br />Notwithstanding any laws and regulations which may be set forth by the state air <br />pollution control board or the department of forestry regarding open burning, open <br />burning of rubbish;ag rbaee, household refuse, refuse, brush, grass, leaves or other <br />materials shall be prohibited. An Exceptions to this prohibition shall be made only for <br />charcoal, which may be burned only in approved grills and barbecues for the purpose of <br />food preparation for human consumption, and for outdoor fireplaces provided such <br />fireplaces have screened burn chambers and chimnevs eauioped with spark arrestor <br />screens <br />Approved by Council <br />December 2, 2002 <br />0 <br />C e c of City Couticil <br />
