AN ORDINANCE • AMENDING AND REORDAINING CHAPTER 12 (FIRE PREVENTION AND PROTECTION), ARTICLE III (FIRE PREVENTION CODE) OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, RELATING TO OPEN BURNING. BE IT ORDAINED by the Council of the City of Charlottesville that Chapter 12, Article III of the Code of the City of Charlottesville, 1990, as amended, is and shall hereby be amended and re -ordained as set forth herein below: Sec. 12-50. Definitions For purposes of this article the following definitions shall apply: (a) Garbage. Putrescible animal and vegetable matter accumulated by a household in the course of ordinary day-to-day living, (b) Household refuse. Waste material and trash normally accumulated by a household in the course of ordinary day-to-day living, (c) Open burning. The burning of any matter in such a manner that the resulting products of combustion from the burning are emitted directly into the atmosphere • without passing through a stack, duct or chimney. (d) Refuse. Trash, rubbish, garbage and other forms of solid or liquid waste, including, but not limited to, wastes resultant from residential, agricultural, commercial, industrial, institutional, trade, construction, land cleaning, forest management, and emergency operations. Sec. 12-59. Open -burning e f fubbi w brush,et^ Notwithstanding any laws and regulations which may be set forth by the state air pollution control board or the department of forestry regarding open burning, open burning of rubbish;ag rbaee, household refuse, refuse, brush, grass, leaves or other materials shall be prohibited. An Exceptions to this prohibition shall be made only for charcoal, which may be burned only in approved grills and barbecues for the purpose of food preparation for human consumption, and for outdoor fireplaces provided such fireplaces have screened burn chambers and chimnevs eauioped with spark arrestor screens Approved by Council December 2, 2002 0 C e c of City Couticil
