Approved by City Council on December 2, 2002 <br />• AN ORDINANCE <br />AMENDING AND REORDAINING SECTION 19-139 OF ARTICLE V <br />OF CHAPTER 19 OF THE CHARLOTTESVILLE CITY CODE, 1990, <br />AS AMENDED, AND ADDING A NEW SECTION NUMBERED 19-95.2 IN ARTICLE IV <br />OF THE CHARLOTTESVILLE CITY CODE, 1990, AS AMENDED, <br />RELATING TO HEALTH CARE COVERAGE FOR RETIRED EMPLOYEES <br />AND PURCHASE OF SERVICE CREDIT TOWARD RETIREMENT. <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that Section <br />19-139 of Article V of Chapter 19 of the Charlottesville City Code, 1990, as amended, is hereby <br />amended and reordained, and a new section numbered 19-95.2 in Article IV of Chapter 19, is <br />hereby added to the Charlottesville City Code, 1990, as amended„ to read as follows: <br />Sec. 19-95.2. Same - Purchase of prior service. <br />(a) Any member in service who has completed five (5) or more years of creditable <br />service may purchase credit for service for all or part of the following: <br />(1) Certified creditable service in the Virginia Retirement System or in <br />is <br />the retirement system of another state or of a political subdivision in <br />this or another state which is not considered in the calculation of a <br />retirement benefit; <br />(2) Time employed by the city under the CETA program; <br />(3) Any period of full-time service rendered to the City of <br />Charlottesville on a temporary or seasonal basis, provided that such <br />period has not been previously included in the creditable service. <br />(4) Active military service in the armed forces of the United States, <br />provided that the member's discharge from the armed forces was not <br />dishonorable. <br />b) For each year of prior service to be credited, the member must pay ten percent <br />(10%) of: (i) the member's present annual compensation or (ii) the member's average <br />annual creditable compensation during the member's thirty-six (36) highest consecutive <br />months of creditable service with the City, whichever is greater. For each year of prior <br />service to be credited, members who are employed as police officers, firefighters, sheriffs, or <br />sheriffs deputies, must pay fifteen percent (15%) of (i) the member's present annual <br />compensation or(ii) the member's average annual creditable compensation during the member's <br />thirty-six (36) highest consecutive months of creditable service with the City, whichever is <br />greater. <br />• (c) Service purchased under this section shall be included in the calculation of creditable <br />service as defined in Section 19-91, but shall not be considered in determining eligibility for <br />
