AN ORDINANCE <br />CLOSING, VACATING, AND DISCONTINUING <br />AN ALLEY, LOCATED IN THE 800 BLOCK OF STONEHENGE AVENUE <br />BETWEEN STONEHENGE AVENUE AND ROCKLAND AVENUE <br />WHEREAS, several owners of property located in the 800 block of Stonehenge Avenue in the <br />Belmont Subdivision (Block 62) have initiated a petition seeking to close an Alley located between their <br />properties; and <br />WHEREAS, the Alley which is the subject of this petition was created, circa 1896, by a subdivision <br />plat recorded in the City's land records for the Belmont Subdivision; however, the City has never accepted <br />the dedicated 15 -foot right-of-way by establishing any public street in this location; and <br />WHEREAS, a joint public hearing by the Planning Commission and City Council was held on <br />October 8, 2002, following notice to the public and to adjacent property owners as required by law; and <br />WHEREAS, after consideration of the factors set forth within the City's November 18, 1991 street <br />closing policy as well as matters specified within § 15.2-2232 of the Code of Virginia, this Council finds and <br />determines that the petitioners' request should be granted; Now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the Alley located in <br />the 800 block of Stonehenge Avenue between Rockland and Stonehenge Avenues is hereby closed, vacated <br />and abandoned discontinued, the Alley to be vacated being more particularly described as follows: <br />A twelve (12) foot platted right-of-way, running approximately 480 feet from Rialto Street to <br />Meridian Street, located between Stonehenge Avenue and Rockland Avenue, as shown on the <br />attached map, drawn by the City Department of Neighborhood Development Services. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall send a copy of this ordinance <br />with plat attached to the Clerk of the Circuit Court for recordation in the current street closing book. <br />Approved by Council <br />December 2, 2002 <br />L <br />1 k of City C uncil <br />
