AN ORDINANCE <br />• CLOSING, VACATING, AND DISCONTINUING <br />A PORTION OF DEDICATED RIGHT-OF-WAY KNOWN AS CEDAR LANE. <br />WHEREAS, Brasco Bay Corporation, owner of,properties locatedat 835 and,841West <br />Main Street(Parcels 183 and 175, City Tax Map 32) has iiiitiated a petition see] ng to`close.a <br />dedicated right-of-way 18 feet in width and known as Cedar Lane; located between these two <br />properties; and <br />WHEREAS, the northern portion of property dedicated for use' as Cedar Lane was.closed in <br />the 1960's when the: Charlbttesville Redevelopment and Housing Authority built.the Westtiaven <br />Apartments, but for unknown reasons, the southern portion of Cedar Lane, running 241 feet from its <br />intersection with West Main Street, was never formally closed, and the adjoining property owner <br />would like to obtain clear title; and <br />WHEREAS, for many years the City's Tax Maps have not reflected the existence of any <br />public easement in this location, nor is there any indication that this portion of Cedar Lane (which <br />would have been created years ago by subdivision plat) was ever constructed or accepted by the <br />City into its streetsystem; and <br />WHEREAS, a joint public hearing by the Planning Commission and City Council was held <br />on September 10, 2002, following notice to the public and to adjacent property owners as required <br />• by law; and <br />WHEREAS, after consideration of the factors set forth within the City's November 18, <br />1991 street closing policy as well as matters specified within § 15.2-2232 of the Code of Virginia, <br />this Council finds and determines that the petitioners' request should be granted; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the 18 -foot <br />wide right -of --way known as "Cedar Lane, is hereby closed, vacated, abandoned and discontinued, <br />the right-of-way to be vacated being more particularly described as follows: <br />An eighteen (18) foot right-of-way, running approximately 241 feet north from West <br />Main Street to its terminus at Westhaven Apartments, and located between Parcels <br />183 and 175, City Tax Map 31, as shown on the attached plat and map, drawn by the <br />City Department of Neighborhood Development Services. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall send a copy of this <br />ordinance with plat attached to the Clerk of the Circuit Court for recordation in the current street <br />closing book. <br />Approved by Council <br />November 4, 2002 C er of City Council <br />
