C. The Grantee has the financial, legal, and technical ability to provide <br />the Services, facilities, and equipment as set forth in Grantee's proposal; • <br />and <br />D. Grantee's proposal was reasonable to meet the future cable -related <br />community needs and interests, taking into account the cost of meeting <br />such needs and interests. <br />4.03 Authority for Use of Streets. <br />A. For the purpose of constructing, operating, and maintaining a <br />System in the City, Grantee may erect, install, construct, repair, replace, <br />relocate, reconstruct and retain in, on, over, under, upon, across and <br />along the Streets within the City such lines, cables, conductors, ducts, <br />conduits, vaults, manholes, amplifiers, appliances, pedestals, attachments <br />and other property and equipment as are necessary and appurtenant to <br />the operation of the System, provided that all applicable permits are <br />applied for and granted, all fees paid and all other City codes and <br />ordinances are otherwise complied with. <br />B. Thirty (30) days in advance of any reconstruction or, rebuild of the <br />System, Grantee shall, in each case, file plans with the City and receive <br />written approval of such plans, which approval shall not be unreasonably <br />withheld. Failure of City to take action on such plans within thirty (30) <br />days of receipt of such plans shall be deemed approval of such plans. <br />C. Grantee shall construct and maintain the System so as not to <br />interfere with other uses of Streets. Grantee shall endeavor to make use <br />of existing poles and other facilities available to Grantee where feasible. <br />Grantee shall widely publicize proposed construction work prior to <br />commencement of that work. Except in cases of an emergency, Grantee <br />shall individually notify in writing all residents reasonably affected by <br />proposed underground work not less than forty-eight (48) hours prior to <br />commencement of that work. Such notice shall include the Grantee's <br />telephone number and the department to call regarding questions about <br />the construction. <br />D. Notwithstanding the above grant to use the Streets, no Street shall <br />be used by Grantee if the City, reasonably determines that such use is <br />inconsistent with the terms, conditions or provisions by which such Street <br />was created or dedicated, or presently used. <br />4.04 Nature of Franchise. Upon acceptance, the Grantee's nonexclusive <br />Franchise for the occupation and use of the Streets within the City for the <br />construction, operation, maintenance, upgrade, repair and removal of the System <br />in accordance with the provisions of this Franchise shall be deemed to have <br />been renewed.
