3.23 "Service Area" or "Franchise Area" means the entire geographic area <br />• within the City as it is now constituted or may in the future be constituted. <br />3.24 "Service Interruption" means the loss of picture or sound on one (1) or <br />more Cable Channels for twenty (20) or more minutes. <br />3.25 "Standard Installation" means any residential Installation which can be <br />completed using a Drop of one hundred fifty (150) feet or less. <br />3.26 "Street" means the surface of and the space above and below any public <br />Street, public road, public highway, public freeway, public lane, public <br />path, public way, public alley, public court, public sidewalk, public <br />boulevard, public parkway, public drive or any public easement or right-of-- <br />way now or hereafter held by the City which shall entitle Grantee to the <br />use thereof for the purpose of installing or transmitting over poles, wires, <br />cables, conductors, ducts, conduits, vaults, manholes, amplifiers, <br />appliances, attachments and other property as may be ordinarily <br />necessary and pertinent to a System. <br />3.27 "Subscriber" means any Person who lawfully receives Cable Service via <br />the System. In the case of multiple office buildings or multiple dwelling <br />units, the "Subscriber" means the lessee, tenant or occupant. <br />• 3.28 "Video Programming" means programming provided by, or generally <br />considered comparable to programming provided by, a television <br />broadcast station. <br />SECTION 4 GRANT OF AUTHORITY AND GENERAL PROVISIONS <br />4.01 Grant of Franchise. This Franchise is granted pursuant to the terms and <br />conditions contained herein. Such terms and conditions shall be subordinate to <br />all applicable provisions of Applicable Laws, rules, and regulations. <br />4.02 Criteria of Selection. The City followed the procedure outlined in Section <br />626 of the Cable Act in granting this Franchise. The City conducted full public <br />proceedings and afforded Grantee reasonable notice and a reasonable <br />opportunity to be heard, during which the City considered whether: <br />A. Grantee had substantially complied with the material terms of the <br />previous Franchise and with applicable law; <br />B. The quality of Grantee's Service, including signal quality, response <br />to consumer Complaints, and billing practices, but without regard to the <br />mix, quality, or level of Cable Services, or other Services provided over <br />the System, had been reasonable in light of community needs over the <br />previous Franchise term; <br />
