revenue consistent with Generally Accepted Accounting Principles), <br />revenues from home shopping Channels, upgrade and downgrade fees, • <br />advertising revenue (to the extent considered revenue consistent with <br />Generally Accepted Accounting Principles), Converter rental fees and <br />Lockout Device fees. The term Gross Revenue shall not include any <br />taxes on Services furnished by Grantee imposed by any municipality, <br />state, or other governmental unit and collected by Grantee for such <br />governmental unit. Franchise fees paid to the City are not deemed to be <br />taxes and are not to be deducted from the total Gross Revenue figure on <br />which Franchise Fees are paid. <br />3.15 "Installation" means the connection of the Cable System from feeder cable <br />to the point of connection including Standard Installations and custom <br />Installations with the Subscriber Converter or other terminal equipment. <br />3.16 "Lockout Device" means an optional mechanical or electrical accessory to <br />a Subscriber's terminal which inhibits the viewing of a certain program, <br />certain Channel, or certain Channels provided by way of the Cable <br />System. <br />3.17 "Normal Business Hours" means those hours during whichmost similar <br />businesses in City are open to serve customers. In all casds, "Normal <br />Business Hours" must include at least one (1) night per week and/or some <br />weekend hours. • <br />3.18 "Normal Operating Conditions" means those Service conditions which are <br />within the control of Grantee. Those conditions which are not within the <br />control of Grantee include, but are not limited to, natural disasters, civil <br />disturbances, power outages, telephone network outages, and severe or <br />unusual weather conditions. Those conditions which are ordinarily within <br />the control of Grantee include, but are not limited to, special promotions, <br />pay-per-view events, rate increases, regular peak or seasonal demand <br />periods, and maintenance or upgrade/rebuild of the Cable System. <br />-3.19 "Other Programming Service" means information that a cable operator <br />makes available to all Subscribers generally. <br />3.20 "Pay Television" means the delivery over the System of pay -per channel <br />or pay -per -program audio-visual signals to Subscribers for a fee or <br />charge, in addition to the charge for Basic Cable Service or Cable <br />Programming Services. <br />3.21 "Person" is any Person, firm, partnership association, corporation, <br />company, limited liability entity or other legal entity. <br />3.22 "Public Property' means any real property, other than a Street, owned by <br />any governmental unit. • <br />4 <br />
