2. Review the construction plans and schedule updates as set <br />• forth in Exhibit A, and monitor the construction of the System <br />upgrade/rebuild and report to the City Council on the same; <br />3. Review all reports and materials submitted by the Grantee to <br />the City as required herein including, but not limited to, Sections 5, <br />8, and 9; <br />4. Review Complaints of Subscribers which have not been <br />satisfied by the Grantee; <br />5. On or before November 1 st of each year, submit a report to <br />the City Council summarizing the Committee's review of reports <br />and materials submitted by the Grantee as provided above, and the <br />Subscriber Complaints; <br />6. Conduct any other review as allowed by the City Council or <br />the Committee pursuant to Applicable Laws; and <br />7. Upon request of City Council, provide input on issues <br />relevant to any periodic evaluation or renegotiation session as more <br />fully described in Section 8.07 of this Franchise. . <br />• SECTION 5. DESIGN PROVISIONS <br />5.01 System Upgrade/Rebuild Construction: Minimum Channel Capacity. <br />A: Grantee shall develop, construct and operate, pursuant to the <br />timeframe specified herein, a System providing a minimum of 860 MHz <br />capacity. Construction will be completed and Channels activated as <br />described in Exhibit A attached hereto. <br />B. The System will utilize a hybrid fiber -coaxial architecture with an <br />initial node size not to exceed 500 homes passed and is further capable of <br />being divided by two (2). In addition, the System will be designed with the <br />capability to transmit return signals upstream in the 540 MHz spectrum. <br />In conjunction with the upgrade/rebuild construction, Grantee shall replace <br />any existing headend equipment with state-of-the-art standard frequency <br />headend equipment which is technically necessary to meet FCC technical <br />standards. <br />C. Grantee shall develop, construct and operate a System capable of <br />providing non -video services such as high-speed data transmission, <br />Internet access, and Other Programming Services. <br />D. Grantee shall provide information to any business or other <br />• Subscriber within City which desires information regarding non -video <br />Services offered by Grantee. <br />
