programming surveys to ascertain the programming desires of Subscribers in the <br />City and shall share such information with the City and the steps which Grantee • <br />will undertake to address the programming needs and interests of Subscribers in <br />the City. <br />6.02 [Reserved.] <br />6.03 Programming Decisions. All programming decisions shall be at the sole <br />discretion of Grantee; provided, however, that any change in the mix, quality, or <br />level of Service shall require the prior notice to the City and shall be done in <br />accordance with 47 U.S.C. § 545 and all Applicable Laws. In all cases Grantee <br />shall provide a minimum of thirty (30) days advance written notice of any <br />programming changes to all Subscribers and to the City. <br />6.04 Emergency Alert System. Grantee shall install and thereafter maintain for <br />use by the City an Emergency Alert System (EAS). This EAS shall be remotely <br />activated by telephone and shall allow a representative of the City to override the <br />audio on all Channels of the System in the event of a civil emergency or for <br />reasonable tests. Grantee shall at all times comply with all Applicable Laws <br />regarding EAS service and Grantee shall not be responsible for Grantor's use or <br />operation of the EAS. <br />6.05 Access Channels. <br />A. The Grantee shall continue to make available for use by the City, • <br />without charge, a minimum of one (1) activated Channel for non- <br />commercial Governmental programming and shall make available, without <br />charge, a minimum of one (1) activated Channel for non-commercial <br />public access programming and shall make available a minimum of one <br />(1) activated Channel for non-commercial educational programming for <br />educational institutions within the City, including those listed in Exhibit D <br />and Piedmont Virginia Community College and the University of Virginia. <br />Additionally, upon completion of the System upgrade/rebuild, the Grantee <br />shall reserve Channel capacity for up to three (3) additional PEG access <br />channels. Grantee shall provide the City with one additional PEG access <br />channel at such time as one PEG access channel is programmed with <br />original and first repeat, non -character generated programming for a <br />minimum of eight (8) hours per day for five (5) days per week for eight (8) <br />consecutive weeks. At such time as two existing PEG access channels <br />satisfy this criteria, Grantee shall provide two additional PEG access <br />channels and at such time as all three existing PEG access channels <br />satisfy this criteria, Grantee shall provide three additional PEG access <br />channels. Grantee shall be given at least sixty (60) days advance written <br />notice before such channel must be made available. The parties hereby <br />agree that any such additional channels may be placed, at the Grantee's <br />option, on either the basic, satellite, or digital tier of service. <br />• <br />14 <br />
