LICENSE AGREEMENT <br />• THIS LICENSE AGREEMENT is entered into this twenty-fifth day of August, <br />2003, by and between the CITY OF CHARLOTTESVILLE, VIRGINIA, (hereafter <br />"City") and the STATE BOARD FOR COMMUNITY COLLEGES, for and on behalf of <br />PIEDMONT VIRGINIA COMMUNITY COLLEGE (hereafter "PVCC"). <br />WHEREAS, PVCC is the owner of undeveloped property located on its <br />Albemarle County campus on State Route 20 south of the City of Charlottesville; and <br />WHEREAS, the City is seeking a suitable area to be used as a public dog run for <br />the benefit of the citizens of the City and Albemarle County; and <br />WHEREAS, the City is willing to make certain improvements to the property in <br />order to allow its use as a dog run (hereafter "facility"). <br />WITNESSETH: <br />That for and in consideration of the mutual promises and covenants hereinafter <br />contained, the parties hereto agree as follows: <br />1. Term: This License Agreement shall remain in effect for a period beginning <br />September 1, 2003 and ending August 31, 2008, unless terminated or amended in <br />• accordance with the terms of the Agreement. <br />2. Location: The facility shall be located on approximately 10 acres of undeveloped <br />property adjacent to State Route 742 (Avon Street) in the northwest comer of the PVCC <br />Campus (hereafter "the property"). Access to the facility shall be from State Route 742. <br />• <br />3. Improvements: All improvements shall be of a temporary nature so that they can be <br />easily removed. Minimal clearing of brush and scrub on the property shall be permitted; <br />otherwise the facility shall use existing open areas, and will not create any new open <br />areas in the woods. The facility shall be fenced and is not to interfere with the running <br />path currently located in the wooded area. A gravel parking lot for up to 12 vehicles may <br />be provided on the property. A maximum of two (2) self-contained toilets may be located <br />at the facility. The initial improvements, and all subsequent improvements, must be <br />approved by the PVCC. <br />4. Maintenance and Repair: The City shall be responsible for all maintenance and repair, <br />including cleanliness, trash removal, and dog waste removal. Failure to maintain the <br />facility in a satisfactory manner, as determined by PVCC, shall constitute cause for <br />termination if the City has not remedied the situation, following written notice and a <br />period of fifteen (15) days to cure. <br />5. Use of the Facility: The facility may be open to the public from dawn to dusk <br />(daylight hours only). PVCC shall have priority to schedule the facility for instructional <br />Page 1 <br />
