Adopted by Council on September 20, 2004 <br />• AN ORDINANCE TO AMEND AND RE -ORDAIN <br />CHAPTER 15 (MOTOR VEHICLES AND TRAFFIC) <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE (1990), AS AMENDED, <br />PERTAINING TO ADOPTION OF CERTAIN STATE LAWS AND PENALTIES <br />AND TO CONFORM PROVISIONS PERTAINING TO THE AUTHORITY OF <br />THE TRAFFIC ENGINEER; FINES FOR BLOCKING SNOW ROUTES; <br />DISSEMINATION OF ACCIDENT REPORTS; PARKING <br />IN SPACES RESERVED FOR DISABLED PERSONS; AND THE REMOVAL <br />AND DISPOSITION OF ABANDONED VEHICLES AND TRAFFIC HAZARDS; <br />ALL TO CONFORM WITH PROVISIONS OF STATE LAW <br />BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, that <br />Chapter 15 of the Code of the City of Charlottesville, 1990, as amended, is hereby <br />amended and reordained, as follows: <br />ARTICLE I. IN GENERAL <br />Sec. 15-1. Definitions. <br />(The words, terms and phrases used in this chapter shall have the meanings ascribed to <br />them in the state law adopted by section 15-3, except where the context clearly indicates a <br />different meaning. <br />• (b)Throughout this chapter, the terms "street," "city street' and "alley," whether used <br />alone or in combination, shall each mean and refer to the entire width between the <br />boundary lines of every way or place open to the use of the public for purposes of <br />vehicular travel within the City of Charlottesville, and shall be synonymous with the term <br />"highway" defined within $15-3, below. <br />Sec. 15-2. Violations of chapter. <br />It shall be unlawful for any person to violate any provision of this chapter or any rule or <br />regulation promulgated pursuant to this chapter, including any provisions of state law <br />incomorated into this chanter by reference as set forth within S 15-3, below. Unless otherwise <br />provided, each such violation shall constitute a traffic infraction punishable by a fine of not <br />more than that provided for a Class 4 misdemeanor under <br />Vireinia Code S 18.2-11, plus anv additional monetary penalty that may be allowed by law <br />for serious traffic offenses <br />Sec. 15-3. Adoption of state law. <br />(a) Pursuant to the authority of Code of Virginia, sections 46.2-1300 and 46.2-1313, all of <br />the provisions and requirements of the state I ,S of the state contained in set forth within the <br />following provisions of the Code of Virginia, are hereby adopted, mutatis mutandis, and <br />incorporated by reference, as if set forth herein verbatim, except those provisions and <br />requirements which, by their very nature, can have no application to or within the cites <br />• (1) Title title 46.2, in its entirety; <br />(2) Title 18.2, Chapter 7, Article 2 (S 18.2-266 et seg.), in its entirety: and_�r,.".....o' <br />
