AN ORDINANCE <br />• AMENDING AND REENACTING THE ZONING DISTRICT MAP INCORPORATED <br />IN SECTION 34-1 OF THE ZONING ORDINANCE <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />(AS AMENDED) BY THE RE -ZONING OF <br />PARCELS 124A and 125, CITY TAX MAP 60 (1014 Druid Avenue) <br />FROM "R -1S" TO "PUD" <br />WHEREAS, Druid Avenue LLC ("Applicant") has made application for a rezoning of <br />.portions of Parcels 124A and 125, City Tax Map 60 (together, "Subject Property") from "R - I S" <br />to "PUD" ("Proposed Rezoning"), subject to a PUD Development Plan dated February 16, 2004, <br />as modified April 20, 2004 and February 3, 2005, and the narrative materials and sketches <br />attached thereto (together, "PUD Development Plan") submitted by the Applicant as part of ZM- <br />02-04; and <br />WHEREAS, a joint public hearing on the Proposed Rezoning was held before the City <br />Council and Planning Commission on April 12, 2005, following notice to the public and to <br />adjacent property owners as required by law; and <br />WHEREAS, on April 12, 2005 the Planning Commission voted to recommend the <br />Proposed Rezoning; and <br />WHEREAS, this Council finds and determines that: <br />(I )The Proposed Rezoning is consistent with the Comprehensive Plan, and with the <br />• purpose and intent of the Planned Unit Development District, as articulated within the City Code, <br />Chapter 34, Article V; and <br />(2)The existing zoning and the proposed zoning district classification are both <br />reasonable; and <br />(3)The public necessity, convenience, general welfare, or good zoning practice requires <br />the Proposed Rezoning. <br />Now, therefore, BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that the Zoning District Map Incorporated in Section 34-1 of the Zoning Ordinance of <br />the Code of the City of Charlottesville, 1990, as amended, be and hereby is amended and <br />reenacted as follows: <br />Section 34-1. Zoning District Map. Rezoning from "R-1 S" Residential to Planned Unit <br />Development (PUD) district all of the property, consisting of approximately 0.69 acres <br />(approximately 30,172 square feet) currently identified on City Tax Map 60 as portions of <br />Parcels 124A and 125, subject to the following: all development must conform to the density, <br />height and other dimensional requirements, the general location of streets and other public <br />improvements, the nature and general location of uses, and the setbacks and other development <br />conditions identified and depicted within the PUD Development Plan and within the Final Proffer <br />Statement dated April 20, 2004, revised March 21, 2005. <br />Approved by Council <br />.
