AN ORDINANCE <br />• AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED <br />IN SECTION 34-1 OF THE ZONING ORDINANCE <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />AS AMENDED, BY THE RE -ZONING OF PORTIONS OF <br />PARCEL 50 OF CITY TAX MAP 54, <br />FROM "R-2" TO "HW" <br />WHEREAS, the Owner of Parcel 50, City Tax Map 61, has submitted an application <br />seeking a rezoning of that parcel from "R-2 Residential District" to "Highway Corridor Mixed <br />Use District (HW)" (hereinafter, the "Proposed Rezoning"); and <br />WHEREAS, a joint public hearing on this application was held before the City Council <br />and Planning Commission on April 12, 2005, following notice to the public and to adjacent <br />property owners as required by law; and <br />WHEREAS, on April 12, 2005 the Planning Commission voted to recommend the <br />Proposed Rezoning; and <br />WHEREAS, this Council finds and determines that the public necessity, convenience, <br />general welfare or good zoning practice requires the Proposed Rezoning; that both the existing <br />"R-2" zoning and the proposed "HW" zoning classifications are reasonable; and that the <br />Proposed Rezoning is consistent with the concept and purpose sof the City Code, Chapter 34, <br />Is Article VI, §34-541(9); Now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the <br />District Map Incorporated in Section 34-1 of the Zoning Ordinance of the Code of the City of <br />Charlottesville, 1990, as amended, be and hereby is amended and reenacted as follows: <br />Section 34-15. Zoning District Map. <br />Rezoning from R-2 Residential to Highway Corridor Mixed Use District (HW) the <br />property identified as Parcel 50 on the City's Tax Map 61, having frontage on Linden Avenue, <br />and containing approximately 22,174 square feet (SF), or approximately 0.5090 acres of land. <br />Approved,ibyyCouncil <br />June 6, 2005 <br />Ci",k of <br />.
