ZM-05-03-05 <br />' AN ORDINANCE <br />AMENDING AND REENACTING THE ZONING DISTRICT MAP INCORPORATED <br />IN SECTION 34-1 OF THE ZONING ORDINANCE <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />(AS AMENDED) BY THE RE -ZONING OF <br />PARCEL 277.1 (Lots E, F, G & H), CITY TAX MAP 4 (1200 Block of John Street) <br />FROM "11-213" TO "PUD" <br />WHEREAS, Piedmont Housing Alliance ("Applicant') has made application for a rezoning of <br />Parcel 277. 1, Lots E, F, G & H, on City Tax Map 4 (together, "Subject Property") from `R -2U" to "PUD" <br />("Proposed Rezoning"), submitted by the Applicant as part of ZM-05-03-05; and <br />WHEREAS, ajoint public hearing on the Proposed Rezoning was held before the City Council <br />and Planning Commission on April 12, 2005, following notice to the public and to adjacent property <br />owners as required by law; and <br />WHEREAS, on April 12, 2005 the Planning Commission voted to recommend the Proposed <br />Rezoning; and <br />WHEREAS, this Council finds and determines that: <br />(1)The Proposed Rezoning is consistent with the Comprehensive Plan, and with the purpose and <br />intent of the Planned Unit Development District, as articulated within the City Code, Chapter 34, Article <br />• V; and <br />(2)The existing zoning and the proposed zoning district classification are both reasonable; and <br />(3)The public necessity, convenience, general welfare, or good zoning practice requires the <br />Proposed Rezoning. <br />Now, therefore, BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that <br />the Zoning District Map Incorporated in Section 34-1 of the Zoning Ordinance of the Code of the City of <br />Charlottesville, 1990, as amended, be and hereby is amended and reenacted as follows: <br />Section 34-1. Zoning District Map. Rezoning from "R -2U" Residential to Planned Unit Development <br />(PUD) district all of the property, consisting of approximately 0.44 acres currently identified on City Tax <br />Map 4 as Parcel 277.1 (Lots E, F, G & H), conditioned upon administrative approval of the final site plan. <br />Approved by Council <br />May 16, 2005 <br />ku <br />C er of City Council <br />• <br />
