AN ORDINANCE <br />• AMENDING AND REENACTING THE ZONING DISTRICT MAP INCORPORATED <br />IN SECTION 34-1 OF THE ZONING ORDINANCE <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, <br />(AS AMENDED) BY THE RE -ZONING OF <br />PARCELS 91,127 and 128, CITY TAX MAP 23 (PATON & MOORE STREETS) <br />FROM "R -1S" and "R-2" TO "PUD" <br />WHEREAS, Greater Charlottesville habitat for Humanity, Inc. ("Applicant') has made <br />application for a rezoning of Parcels 91, 127 and 128, City Tax Map 23 (together, "Subject Property") <br />from "R-1 S" (Parcel 91) and "R-2" (Parcels 127 and 128) to "PUD" ("Proposed Rezoning"), subject to a <br />PUD Development Plan dated December 21, 2004 and the narrative materials and sketches attached <br />thereto (together, "PUD Development Plan") submitted by the Applicant as part of ZM-04-12-23; and <br />WHEREAS, a joint public hearing on the Proposed Rezoning was held before the City Council <br />and Planning Commission on February 8, 2005, following notice to the public and to adjacent property <br />owners as required by law; and <br />WHEREAS, on February 8, 2005 the Planning Commission voted to recommend the Proposed <br />Rezoning; and <br />WHEREAS, this Council finds and determines that: <br />(1)The Proposed Rezoning is consistent with the Comprehensive Plan, and with the purpose and <br />intent of the Planned Unit Development District, as articulated within the City Code, Chapter 34, Article <br />• V; and <br />(2)The existing zoning and the proposed zoning district classification are both reasonable; and <br />(3)The public necessity, convenience, general welfare, or good zoning practice requires the <br />Proposed Rezoning. <br />Now, therefore, BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that <br />the Zoning District Map Incorporated in Section 34-1 of the Zoning Ordinance of the Code of the City of <br />Charlottesville, 1990, as amended, be and hereby is amended and reenacted as follows: <br />Section 34-1. Zoning District Map. Rezoning from "R -I S" and "R-2" residential to Planned Unit <br />Development (PUD) district all of the property, consisting of approximately 2.244 acres (approximately <br />97,748.64 square feet) currently identified on City Tax Map 23 as Parcels 91, 127 and 128, subject to the <br />following: all development must conform to the density, height and other dimensional requirements, the <br />general location of streets and other public improvements, the nature and general location of uses, and the <br />setbacks and other development conditions identified and depicted within the PUD Development Plan. <br />Approved by Council <br />March 21, 2005 <br />Cl c of City Council <br />
