AN ORDINANCE <br />• AMENDING AND REORDAINING <br />SECTIONS 34-242, 34-251, 34-252 AND 34-254 OF <br />ARTICLE II, DIVISION I OF CHAPTER 34 (ZONING) OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE (1990), AS AMENDED, <br />RELATING TO FLOOD HAZARD PROTECTION <br />OVERLAY DISTRICT REGULATIONS (ZT--04-12-24) <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that Article II, Division <br />I, Sections 34-242, 34-251, 34-252 and 34-254 of the Code of the City of Charlottesville, 1990, as <br />amended, are hereby amended and re -ordained, as follows: <br />C, <br />J <br />Sec. 34-242. Applicability. <br />(a) .... <br />(b) The floodplain areas identified by the Federal Emergency Management Agency in its <br />Flood Insurance Rate Map (FIRM) dated T....9 February 4, 2005, with <br />accompanying maps and other supporting data, and any revisions thereto, are adopted by <br />reference and declared to be part of this ordinance. <br />Sec. 34-251. Flood hazard reduction—specific standards. <br />In all areas of special flood hazard where base flood elevation data has been provided, the following <br />provisions are required.... <br />Elevated Buildings. New construction or substantial improvements of elevated buildings <br />that include fully enclosed areas that are usable solely for the parking of vehicles, bu9lding <br />access or storage in an area other than a basement, and which are subject to flooding shall be <br />designed to preclude finished living space and be designed to automatically equalize <br />hydrostatic flood forces on exterior walls by allowing for entry and exit of floodwaters. <br />Designs for complying with the requirement must either be certified by a professional <br />engineer or meet the following minimum criteria: <br />(1) .... <br />(2) The bottom of all openings shall be no higher than three feet one foot above <br />grade, and;.... <br />(3) .... <br />(4) .... <br />(5) .... <br />Sec. 34-252. Restrictions governing development in the floodway. <br />• (a) Located within certain areas of special flood hazard are areas designated as <br />floodway.
